Victory against unconstitutional search and seizures.

    By Michael Komorn

Komorn Law PLLC is proud to report another complete dismissal of all charges for our client. These past few months we have attained a high rate of dismissals of our client’s cases.   In this case our client was charged with allegations of felonious marihuana conduct; the case involved the definition of a medical marijuana plant in the law. More specifically, whether or not the plant was producing food from photosynthesis and was “living”.  Of course, the prosecutor wanted to fight abo

Making A Federal Case Out Of Marijuana

    By Michael Komorn

Our client, a medical marijuana patient registered with the State of Michigan, was out for a boat ride and some fishing on his friend’s boat. What started out as a glorious day with intentions of sun and fishing on the Detroit river later turned into federal charges of possession of marijuana (21 USC 844, 21 USC 844a) when a Border Patrol agent pulled up to them and wanted to search their vessel.   Related: Michigan law regarding marijuana manufacture, delivery, and possession   The federal

Don’t Beauregard that joint my friend.

    By Michael Komorn

Attorney General Jeff Sessions January 4th memo regarding marijuana enforcement is historic... and it should promptly be consigned to the dustbin of history. Mr. Session’s very name is a history lesson. Like his father and grandfather, he was named after Jefferson Davis, the first and only president of the Confederacy and P.G.T. Beauregard, the first prominent general of the Confederate Army. These were the men who lead the people of Alabama in their desire and purpose to join the “slave-holding

9 % Decrease In Driving Fatalities In Medical Marihuana States

9 % Decrease in Driving Fatalities in Medical Marihuana states Med. marijuana laws = 9 percent traffic-death decline, 5 percent beer-sales dip, study finds   The subject of driving under the influence of marijuana has been much debated in these parts. A bill to set a THC driving limit was shelved in May, shortly before an HDNet report demonstrated pot-related driving impairment -- and in August, the Colorado Department of Transportation launched a drugged-driving campaign. Now, however, a n

Results Of The Medical Marihuana Survey

Although I posted the results of my survey a few days ago, I was not going to release it for comments until I posted the narrative. If you could see and feel my hands right now, you would know that it will be a while for that narrative to be completed.   In August, when I first offered a survey; I had hoped to receive hundreds, up to a thousand responses. I am so glad I didn’t. I printed each survey, blocked out the names, and then divided the work by gender. I had not anticipated the level of

The Medical Use Of Marihuana As A Health Care Issue

The Medical Use of Marihuana as a Health Care Issue © 2011 Chocolate Cherri     December 3, marks the completion of three years of the Michigan Medical Marihuana Act. For me, those three years have been adventurous. Because most here don’t know me, I won’t get into it, for those who do, what a ride.   I see the road ahead as being very rocky. With all fights, there will attempts to divide and separate. The cannabis road is no different. Separation is not necessarily a bad thi

The Medical Miracle That You'll Get Arrested for Using By Dr. Mercola http://www.foodconsumer.org/newsite/Non-food/Drug/marijuana_1126110736.html Marijuana was a popular botanical medicine in the 19th and 20th centuries, common in U.S. pharmacies of the time. Marihuana: Don’T Fear, It’S Here, Let’S Work With It!

At 12:01a on November 4, 2011; the state of Michigan will start its fourth year as a Medical Marihuana state. WOW!   Year one was kinda quite. Although the Michigan Medical Marihuana Act went into effect on December 4, 2008; no one was able to apply as a registered patient until April6, 2009. On that day, there were loads of people at the Department of Community Health office in Lansing, eager to submit their applications. Who cared that the receipt of ID cards were a day or two late, the elat

Good Advice - Grasshopper

Good Advice   This was passed on by a friend. Good advice... ONE Light Bulb at a Time? A physics teacher in high school, once told the students that while one grasshopper on the railroad tracks wouldn't slow a train very much, but billion of them would. With that thought in mind, read the following. This past weekend I was at Kroger. I needed 60 W light bulbs and Bounce dryer sheets. I was in the light bulb aisle, and right next to the GE brand Informally buy was an off-brand labeled, "Eve

12 Oz Is All That Is Smoked In One Year

If you use a quarter a week that comes to less then one pound more like 12 oz. So the laws say you can possess more then one plant, which if grown correctly will produce over ten pounds of buds. If you grow according to the laws then you are almost for sure going to possess to much Cannabis. The laws are wrong and were made to limit the amount, yet they state you can have more then one plant. I have seen plants that produced over ten pounds each, my point is that the normal use is under one p

Cost Of Marijuana Vs "antiemetic" Drugs

An excerpt from a true story...by Paul Kuhn, a business man, 1997.   ...During the course of her treatment my wife consumed less than $200 worth of cannabis, while undergoing her treatment of advanced breast cancer. To prevent nausea she smoked marihuana, and it worked perfectly. A single puff brought immediate relief. She was never sick and continued to eat well. The necessary dose of Zofran (ondansetron), the antiemetic our oncologist first recommended, would have cost one hundred times t
