The Medical Cannabis (Marijuana) License Handbook for New Mexico

Published April 07, 2009 by: David Arbuckle

This Handbook Can Be Used for Other States That Offer Medical Marijuana as a Treatment

One of the things you need to understand is the State of New Mexico is not going to make it easy to obtain a license for medical Marijuana. It is referred to the Medical Cannabis Program. The State of New Mexico will be one of the strictest states that will issue these licenses. If you follow the steps in this booklet it may make it easier for you to obtain a medical cannabis license in the State of New Mexico. This booklet can be used as a guide in all states that offer medical marijuana as a treatment.

The very first step to obtaining a medical marijuana license know what your symptom are and ensure it qualifies for the in the state you are applying for. In this instance the State of New Mexico. In almost every case every state will ensure that symptoms are severe, long lasting and you have tried every treatment available. Every state is different and since I am writing about New Mexico it is important that you understand that just having severe chronic pain and nausea will not qualify in this state. I believe it's just a matter of time before New Mexico loosens up a bit on its qualifications. It's important you read and review your state's list of conditions that you may qualify for.

There are fourteen qualifying conditions the State of New Mexico recognizes. Cancer, glaucoma, multiple sclerosis, damage to the nervous tissue of the spinal cord with intractable spasticity, epilepsy, HIV/AIDS, painful peripheral neuropathy, intractable nausea/vomiting, severe anorexia/cachexia, hepatitis C infection currently receiving antiviral treatment, Crohn's disease, Post-traumatic Stress Disorder and Amyotrophic Lateral Sclerosis (Lou Gehrig's disease). Hospice patients may also be eligible. This information can be found at www.health.state.nm.us/marijuana.html.

It's important to have a relationship with your doctor. Your doctor knows you and your symptoms and how you have been treated. Your doctor knows you have been suffering and can ensure the state they have tried every possible treatment and medical marijuana is the next step. Remember anybody can complain about having pain, as a matter of fact chronic pain and nausea is the most common condition people obtain a license for in other states. This will not work in New Mexico. The reason the doctor knows that a patient is in pain and has nausea is because the patient is complaining about them. The doctor may take your word for it, but there is no way the State of New Mexico will. You must have a qualifying condition and have been treated before being issued a medical marijuana license in the State of New Mexico.

What happens if you have been recently diagnosed and don't have history of treatment? This section will cover what you need to do. Building your medical History takes time. If you are already a long time sufferer of one of the qualifying conditions it is very likely you have an extensive medical history and your medical records will reflect that. However if you have been recently diagnosed it will take approximately six month to a year to obtain a sufficient medical history. Legitimate medical records are the key to obtaining a recommendation for a medical marijuana license. Your medical record is the most important tool you have for obtaining a medical marijuana license. You should be requesting photo copies of everything in that medical record. Records get lost. If you move to a state that offers medical marijuana, you will already be ahead of the game having a copy of your medical history. Remember your medical record is the only proof you have that shows you suffer from these qualifying conditions. Treat it like gold.

You need to be careful when trying to obtain a license for medical marijuana. Doctors are smart and very good at detecting individuals who are drug seeking. If the doctor suspects you are a drug abuser, they will write it in your medical record. If marijuana truly helps you ensure your doctor understand that.

When building your medical history it is extremely important your doctor believes your complaint. Remember the state of New Mexico will not issue a cannabis license for a complaint of chronic pain or nausea. You will have to be diagnosed with one of the fourteen qualifying conditions.

First and foremost, never ask your doctor directly for a medical marijuana license. If you do go find a new doctor and start over. No doctor will prescribe medical marijuana as a first treatment. When talking to you doctor about your complaint always be consistent. Never self-diagnose or ask for a specific treatment. Tell your doctor what your complaint is and let your doctor decide how you should be treated. Make sure you follow the doctor's instructions, get all lab tests done, X-rays, CAT scans, what ever is ordered. It's important you ensure your doctor you care about your health. Everything your doctor orders is evidence that will be placed in your medical record. It is not important at this time weather the tests show a positive result. Remember you are building a medical history and it takes time. Always follow up with your doctor. It shows you are serious about resolving your medical issues. Fill your prescriptions; doctors can verify if the prescriptions are being filled. Always be honest with your doctors. If the medications they prescribed are not working let your doctor know. Your doctor does not like to see you in pain, or know the drug they prescribed caused you more problems.

Remember you can not obtain a license for medical marijuana unless you established a medical history and have a qualifying condition. In states where chronic pain and nausea are a qualifying condition it's a bit simpler qualifying for a medical marijuana license. Remember to be consistent, with what you tell your doctor. For example, "I have been experiencing back pain for over 20 years". "I have been to physical therapy several times and I have not improved". "I've tried everything for my nausea, even over the counter medications and still have not relief. Doctors want to help you and understand what you are going through. If your doctor can't help they should refer you to a Specialist. It's up to you to follow through. The more you do to show you have tried everything the better your chances of obtaining a medical marijuana license.

Now you have an extensive medical history. Your medical record is your tool to help you obtain a medical marijuana license. You should already have copies of your medical record just in case yours gets lost. What next? How do you get the doctor on your side? Earlier I stated never ask your doctor out right for a medical marijuana license. There is a way of bringing it up. It won't be a bad idea to have an application for medical marijuana license nearby. Make appointment with your doctor about your condition. Let your doctor know that the treatment is not helping. That you have been suffering a very long time and nothing seems to work. Tell the doctor that you have been searching the worldwide web looking for alternative treatments. Tell the doctor you came across several articles of individuals who have been helped with medical marijuana. (Do the research, it's out there) What ever you do never use street terms when discussing medical marijuana with your doctor. For example, don't call it, weed, ganja, pot; always use the medical terminology when discussing medical marijuana. If you have tried some marijuana and it truly helps you feel better and lessons your symptoms, tell you doctor. Let them know how much it helped you. Tell your doctor that the marijuana worked better than anything you have been prescribed. Than ask the doctor if they would be willing to recommend it for you. If your doctor is reluctant, them how much it helped you. Show them the application and ask the doctor to look it over. Don't get angry if your doctor refuses to help you obtain a medical marijuana license. Not all doctors agree that marijuana is a good treatment. Ask your doctor if they can refer you to someone who might be willing offer this treatment. Do your research and locate a doctor who comfortable recommending medical marijuana as a treatment. Remember you have the documentation already now you just have to find a doctor who believes in this treatment.

Most states that offer medical marijuana as a treatment have medical marijuana dispensaries that have doctors on call. New Mexico will soon have these medical marijuana dispensaries. New Mexico patients in the Medical Cannabis Program can also apply to produce up to 4 mature plants and 12 seedlings for their personal use. So far, the Department has approved 23 patients to be their own producers in the state. This information can be located at www. health.state.nm.us/marijuana.html.

This information booklet can be used to assist your in obtaining a medical marijuana license in every state that offers medical marijuana. Each state will have a list of qualifying conditions and they differ from state to state. It's important to remember that you know, registration in the New Mexico Cannabis Program does not protect you from federal law. Check you local State and Federal laws.

You can obtain applications for medical marijuana license from the states offering them. You will have to be a resident of the state to apply. In almost every state there will be a filing fee.

It is important you know you can obtain legal protection from the state for treatment with medical marijuana. If you are using this booklet to help you in the state of New Mexico, it is important you use the proper terminology. In New Mexico it is the Medical Cannabis Program, not the medical marijuana program. Understand you may have state protection, and not federal protection. This booklet is a guide to assist you through the process in obtaining a medical marijuana license. Always be honest and forthright when applying for medical marijuana. This booklet in not intended for individuals to obtain a medical marijuana license fraudulently or unlawfully. It is your right to be protected while using medical marijuana as a treatment. Use your states system and get protection.
