Excerpts from a Detroit Free Press article....

The Detroit Election Commission voted 3-0 Monday to regect a Nov. 2 ballot proposal

that whould have asked Detroit voters to legalize small amounts of Marijuana.

 

Members of the commission said they were folloing a recommendation by the city's Law Department,

which said the proposal was preempted by state law forbidding possession of the drug..

 

Another example of the Marijuna Haters subverting the will of the people...

Time to get all the 420Friendly people to the polls in record numbers this November...

Safermich friends, what some of you have heard about the Detroit Election Commission voting 3-0 yesterday to deny ballot status to the Coalition for a Safer Detroit's mj reform initiative true. While we did not think this was going to happen, it is foolish to expect anything in Detroit and elsewhere--- when it comes to the ballot initiative process. When any person/group is on the cutting edge of political and social change, legal expenses are simply a cost of doing business. We understood that from the beginning. We will be in court very soon. Litigation constraints prohibit me from publicly saying anything more. I will leave you with one closing thought: Just as "junk science" exists so does "junk law."

When we let the premise of this argument be that we need to vote for our rights, we have already lost.

Rights cannot be given or granted by any person or group. They are yours because you exist. Either we own ourselves or a tyrannical government is in charge.

So, you asked what we think.

I think that until we make elected and non-elected officials swear to do all that they can to protect our individual human rights that we will keep playing games with voting for this opinion or that one while "sacrificing the individual humans for the good of the group".

My opinion is that unless we demand that our individual human rights be protected above all else (as long as we do not infringe on the rights of another to live for their own sake) that we are just spinning our wheels.

However, if we can just win the "RIGHTS" battle one item at a time, then so be it, and bless all who are trying, but some of us cringe when we hear things like "vote for rights", so please understand that we need not be satisfied when the MMJ battle is won.

We need to insist that we have the right to our own lives, unencumbered by the threat or use of force against us by any thug or gang or tyrant or dictator or mob or government, and that as long as we are not infringing on another's right to live for their own sake, we have free will and can choose for ourselves what we will do.

To deny a person their free will is tyranny.

BB, thank you for all you do. You know all this stuff. Just some thoughts...

There will be a legal challenge to this outrageous act by the voting commission who voted 3-0 to not allow this on the ballot. Mr Pugh was shown to be a total hypocrite as court proceedings will hopefully reveal. It ain't over till it's over

Subj: ARO: Detroit Ballot Initiative.

Greetings everyone. I would like to take a moment to clear up any

misconceptions with respect to the City of Detroit Election Commissions decision on

Monday, not to place the Coalition for a Safer Detroit's marijuana reform

proposal on the Detroit Ballot in November.

I will start by saying that when one is on the cutting edge of

political and social change, litigation expenses are simply a cost of doing

business.

In the past few days, issuing press releases and ginning up

publicity about the Detroit Election Commissions has not been a priority.

Our complete focus has been on polishing the legal paperwork to

overturn this decision in Wayne Circuit Count-- and if necessary proceed all

the way to the State Supreme Court.

Before the end of the day today, the Coalition will file a

"Complaint for Mandamas and Motion to Show Cause" in Wayne County Circuit Court to

overturn the Commissions decision.

To put it in simple terms, the Detroit Election Commission and the

Detroit Law Department has degenerated over the years. They are no longer

the legal entities they are supposed to be, as empowered by the City

Charter. They are simply a political cabal where the rule of law is secondary to

whatever political whim du jour prevails at any given time.

The commissions main "legal" reason for keeping this issue off the

ballot is because "state law" preempts them from doing so.

When asked during the "public comment" part of the hearing why

state and federal law now preempts the voters from amending a city ordinance

(hich they did in August 2004 to grant an exemption for medical use of mj,

and the City Council itself did the same thing in 1997 to allow for a

"needle exchange" program)Election Commissioner and City Council President

Charles Pugh declared the "needle exchange program was a good law, this (our mj

initiative) is a BAD law" as his reason for voting the way he did.

No foks, I'm not making this up. The hearing proceeds are tape

recorded. Mr. Pugh cannot wiggle out of this. The other two commissioners

were bit more subtle, in that our proposal was simply "illegal" so they cannot

put it on the ballot.

Hope this information is helpful to all concerned, and puts to

rest any rumors suggesting Safer Detroit's ballot initiative is DOA.
