Foia To Dch Re: Mmma Issues

I forwarded this FOIA request to the DCH a couple of days ago. If anyone has access to any of the information that I’m requesting from them, please let me know.

To the Michigan Department of Community Health’s Freedom of Information Act Coordinator,

 

I am hereby requesting copies of the following public records under the authority of Michigan’s Freedom of Information Act:

 

1. Any public record(s) that indicates the number of renewal applications filed for medical marihuana registry identification cards for patients and caregivers since April of 2009.

 

2. Any public record(s) that indicates the number of qualifying medical marihuana patients and primary caregivers approved in each Michigan county since April of 2009.

 

3. Any public record(s) that indicates the nature of the debilitating medical conditions of all qualifying medical marihuana patients since April of 2009.

 

4. Any public record(s) that indicates the number of medical marihuana registry identification cards that have been revoked since April of 2009.

 

5. Any public record(s) that indicates the number of physicians that have provided written certifications for qualifying medical marihuana patients since November of 2008.

 

6. All public record(s) pertaining to any written petitions received by the DCH from any person or organization requesting that a particular medical condition or treatment be included in the list of debilitating medical conditions under DCH rule 333.101.

 

7. Any public records that indicate who the DCH has appointed as members to review petitions to add medical conditions or treatments to the list of debilitating medical conditions under DCH rule 333.101 (5).

 

8. Any public records that indicate who the support staff is that the DCH has appointed to assist the review panel members with the scheduling of meetings, conference calls, dissemination of petition-related materials, and to perform other administrative duties related to the performance of the panel's review.

Exactly how do you turn it in? Mail? what kind of mail? Is this the actual letter sent in?

 

Just want to know so I can do FOIA requests myself.

Not after you get that bill. You have to pay for FOIA requests you know--per page and employee time. If there is a specific piece of info you want then you are better off asking for just that info and NOT any and all.

I have a couple more question:

 

1.Are you going to see if you can get any info on an appeal?

 

2.In what forms do these records requested exist in if not public record and who has them? (please list any and all types of record storage and where they are stored)

The numbers of patients, caregivers, and applications must exist somewhere for public record because I see them quoted in articles all the time.

Seems like this is just an attempt to stone wall and not provide the requested information. If they use a computer to generate any of their information my guess would be that they can, and probably are, gathering statistical information. No way would MDCH be spouting off statistics in a public meeting if they weren't keeping this information and have easy access to the information.
