pic book
How would I go about appealing a denied motion? Good luck with that. You might call atty Tim Emmerson 616-813-1219. Super personable and busy, but unique practitioner as often is still answering his phone at 8 to 9pm at night (and that often is the only time when he is able to take the time to consider new issues). He is a mj litigation specialist/real estate advisor/practictioner too. No guarantees, but I have had good experience/turn outs with his advice. By the way, also a decorated scholar pre-law. Also, initial free phone conference and thereafter $50/hour (on some issues), in my experience, unique as attys go. As I am so positive about him in my review I feel compelled to say he is not any relation and is not presently retained by me. Good luck with your issue. jtgeme
How would I go about appealing a denied motion? It depends. Of course a typical lawyer answer, but in reality it depends on the motion, the resolution, etc. Without more information its tough to answer. http://coa.courts.mi.gov/rules/ That is the site for the Michigan Court of Appeals, and its a link to the Michigan Court Rules which will likely help to answer your question. keep in mind, appeals have a time limit, and once expired it could difficult/impossible to appeal. . lawyercaregiver
How would I go about appealing a denied motion? Objection overbroad, and calls for legal conclusion. Get a law degree/pass the bar and practice for a few years, or get a paralegal degree and work for a law firm. Alternatively you can hire somebody who has this experience. Just FYI only a small fraction of attorneys ever engage in much appellate practice.....I consider myself fairly experienced with 10 appeals in 12 years of practice. If a criminal case you can often get a court appointed lawyer for a legitimate appeal. In a civil case try legal aid in your area.
dutch&Dutchess
Thanks dutch real helpful... bump. How long is a typical time frame between motion denial and the end of the appeal time? usually 30 to 90 days as a former paralegal I learned one must pay attention to those damnable details. Have you hired a lawyer yet?
