These beings need to take a good, hard look at themselves in the mirror and look deep within themselves. They have traded common sense and decency for greed and power. 13 (e) Marihuana, Subject to section 17790, marihuana, but only

 

 

 

14 for use as provided in sections 7335 and 7336 the Michigan

 

 

 

15 medical marihuana act, 2008 IL 1, MCL 333.26421 to 333.26430.

 

 

 

16 Sec. 17790. (1) Medical marihuana shall not be grown, sold,

 

 

 

17 distributed, possessed, used, transported, or delivered for use

 

 

 

18 under the Michigan medical marihuana act, 2008 IL 1, MCL

 

 

 

19 333.26421 to 333.26430, unless grown and sold through a medical

 

 

 

20 marihuana growing facility licensed under this section. A

 

 

 

21 pharmacist shall not dispense medical marihuana as a schedule 2

 

 

 

22 controlled substance under this act unless it has been grown at a

 

 

 

23 medical marihuana growing facility licensed under this section.

 

 

 

24 (2) A person shall not operate a medical marihuana growing

 

 

 

25 facility in this state until issued a license under this section.

 

 

 

26 No more than 10 medical marihuana growing facilities shall be

 

 

 

27 issued a license under this section during any 1-year period. A

 

 

 

1 license issued under this section is not assignable or

 

 

 

2 transferable.

 

 

 

3 (3) Before a medical marihuana growing facility is

 

 

 

4 established, the owner or operator of the proposed facility shall

 

 

 

5 submit complete drawings to the department for examination and

 

 

 

6 approval. The drawings shall be drawn to an indicated scale, give

 

 

 

7 the relative location of the medical marihuana growing facility,

 

 

 

8 and illustrate all rooms, buildings, facilities, and equipment to

 

 

 

9 be used in the medical marihuana growing operations.

 

 

 

10 Specifications prescribed by rules promulgated under this section

 

 

 

11 shall accompany the drawings. When the construction and

 

 

 

12 establishment of a proposed medical marihuana growing facility

 

 

 

13 are completed, the owner or operator of the proposed facility

 

 

 

14 shall notify the department. The department shall inspect the

 

 

 

15 buildings and premises in which the medical marihuana growing

 

 

 

16 facility are contemplated. If the building and premises conform

 

 

 

17 to the approved plans submitted under this section or rules

 

 

 

18 promulgated under this section and a license is available to be

 

 

 

19 issued under this section, the department shall issue to the

 

 

 

20 applicant a license to conduct a medical marihuana growing

 

 

 

21 facility.

 

 

 

22 (4) The department may receive license applications for the

 

 

 

23 operation of a medical marihuana growing facility. The department

 

 

 

24 shall establish procedures to follow if more applications are

 

 

 

25 received than licenses available to be issued under this section.

 

 

 

26 Upon compliance by an applicant with the requirements of this

 

 

 

27 section and rules promulgated under this section and if a license

 

 

 

1 is available to be issued under this section, the department

 

 

 

2 shall issue a medical marihuana growing facility license. The

 

 

 

3 department shall issue a license under this section for a period

 

 

 

4 of 1 year. The initial application and annual license fee for a

 

 

 

5 medical marihuana growing facility license is $2,500.00.

 

 

 

6 (5) The department shall conduct annual inspections of

 

 

 

7 medical marihuana growing facilities to ensure compliance with

 

 

 

8 the requirements of this section and rules promulgated under this

 

 

 

9 section. The department may delegate the duty of inspections for

 

 

 

10 approval of medical marihuana growing facility licenses to a

 

 

 

11 local health department that has the technical and other

 

 

 

12 capabilities to protect the public health, safety, and welfare in

 

 

 

13 this field. The delegation shall not take place unless the

 

 

 

14 department has first consulted with an ad hoc committee that

 

 

 

15 shall be appointed by the department for the purpose of advising

 

 

 

16 on such delegation. Membership on the ad hoc committee shall

 

 

 

17 include representatives of the department, local public health

 

 

 

18 agencies, and an association that represents the medical

 

 

 

19 marihuana growing facilities that would be subject to the

 

 

 

20 inspections. The state shall reimburse each local health

 

 

 

21 department the full amount of the fees collected, as

 

 

 

22 reimbursement for cost of inspection, on vouchers certified by

 

 

 

23 the local health officer and approved by the department.

 

 

 

24 (6) A local governmental unit shall not enact or enforce an

 

 

 

25 ordinance regarding medical marihuana growing facilities. Except

 

 

 

26 as otherwise provided in this section, a medical marihuana

 

 

 

27 growing facility that has been issued a license under this

 

 

 

1 section shall not be subject to arrest, prosecution, or penalty

 

 

 

2 in any manner, or denied any right or privilege, including, but

 

 

 

3 not limited to, civil penalty or disciplinary action by a

 

 

 

4 business or occupational or professional licensing board or

 

 

 

5 bureau, for the growing, transporting, and delivery of medical

 

 

 

6 marihuana for use as prescribed in the Michigan medical marihuana

 

 

 

7 act, 2008 IL 1, MCL 333.26421 to 333.26430.

 

 

 

8 (7) Not later than the thirtieth day before the expiration

 

 

 

9 of an annual license under this section, a person operating a

 

 

 

10 licensed medical marihuana growing facility shall apply for

 

 

 

11 license renewal and shall pay a fee as prescribed by subsection

 

 

 

12 (4). A person operating a licensed medical marihuana growing

 

 

 

13 facility who does not apply for license renewal as required in

 

 

 

14 this subsection is not entitled to license renewal. Upon

 

 

 

15 compliance by an applicant for license renewal with the

 

 

 

16 requirements of this section and rules promulgated under this

 

 

 

17 section and payment of the license renewal fee, the department

 

 

 

18 shall issue a renewal license.

 

 

 

19 (8) The department shall enforce this section and the rules

 

 

 

20 promulgated under this section. The department may suspend,

 

 

 

21 revoke, or deny a license of a medical marihuana growing facility

 

 

 

22 for a violation of this section or a rule promulgated under this

 

 

 

23 section.

 

 

 

24 (9) Upon a finding that an emergency exists requiring

 

 

 

25 immediate action to protect occupational or public health and

 

 

 

26 safety, the department may issue an order, without notice or

 

 

 

27 hearing, reciting the existence of the emergency and providing

 

 

 

1 for the protection of public health and safety. Notwithstanding

 

 

 

2 this section or the administrative procedures act of 1969, the

 

 

 

3 order shall be effective immediately. A person to whom the order

 

 

 

4 is directed shall comply immediately but, on application to the

 

 

 

5 department, shall be afforded a hearing within 15 days. On the

 

 

 

6 basis of the hearing, the emergency order shall be continued,

 

 

 

7 modified, or revoked not later than 30 days after the hearing.

 

 

 

8 (10) The department shall promulgate rules necessary to

 

 

 

9 carry out this section and may appoint an advisory committee to

 

 

 

10 assist in rule development. The rules shall include the

 

 

 

11 following:

 

 

 

12 (a) Plans.

 

 

 

13 (b) Drawings.

 

 

 

14 © Specifications.

 

 

 

15 (d) Construction.

 

 

 

16 (e) Installation of equipment standards.

 

 

 

17 (f) Inspections.

 

 

 

18 (g) Other matters necessary to protect the health, safety,

 

 

 

19 and welfare of the public.

 

 

 

20 (11) The owner, operator, or agent of a medical marihuana

 

 

 

21 growing facility who fails to comply with this section or rules

 

 

 

22 promulgated under this section within the time specified by the

 

 

 

23 department, or who establishes or operates a medical marihuana

 

 

 

24 growing facility in violation of a detailed statement of

 

 

 

25 specifications, plans, or license approved by the department, is

 

 

 

26 guilty of a misdemeanor punishable by imprisonment for not more

 

 

 

27 than 90 days or a fine of not more than $1,000.00, or both, for

 

 

 

1 each violation or noncompliance.

 

 

 

2 Enacting section 1. Sections 7335 and 7336 of the public

 

 

 

3 health code, 1978 PA 368, MCL 333.7335 and 333.7336, are

 

 

 

4 repealed.

 

 

 

5 Enacting section 2. This amendatory act does not take effect

 

 

 

6 unless all of the following bills of the 95th Legislature are

 

 

 

7 enacted into law:

 

 

 

8 (a) Senate Bill No. 616.

10 (b) Senate Bill No. 617.

 

That is really going to hurt everyone. It almost seems like the tax stamp act from the 30's. Our access will be to limited to low quality high priced meds at best. At worst access could be shut off.

You know that just pisses me off! I am a younger guy (31 in a few days), and most of my friends are even younger, a few of them have cards, but almost every one of them has used Cannabis at some point. Out of all the people I know you know how many of them I was able to convince to come to our rally in Lansing in May?...1. That's right, 1, and that was LongHairBri whom I had only just met, and was planning on going long before I met him, and only needed a ride because his car broke down. So there was no convincing there.

 

You know how many of my friends I know that have written their reps'? Zero. (Other than some of the folks I have met here), I am starting to loathe the apathy that I see in my generation.\

 

GET OFF YOUR ASSES PEOPLE. At least do SOMETHING. You don't have to become a mega-activist. Just show up to a rally or 2 and write your reps. Or this law is toast.

There needs to be a online form with a premade letter that people can sign and have it send to all of these reps.. The was one posted here earlier that I filled out but it only sent it to like 2 people......

 

 

I have no idea who all should be receiving this letter. I HATE politics with a passion and can honestly say I am not as involved as I probably should be.

 

 

WHat's the chances of these ammendment getting the super majority vote? I posted this issue in another MMJ forum and was told I was fear mongering, this site was fear mongering, and there was no way that these would pass... I really do not know what to believe.

You forgot the one where nobody is allowed to grow except for the 10 licensed facilities.

Yes, you only have two reps. It's only sending the email to the representatives for your area. Those are the two people you get to vote for and they should be listening to you.

NP, and all of them are the really bad ones. I drive a truck and always keep my meds next to me, so no children can steal them. I'm protecting the children you see... Every bill is either redundant or horrible. We have to have all struck down or we'll be battling them none stop and they'll propose a bunch of garbage just to sneak a kinda crappy one in there. BTW I've printed out 100 of those flyers and I'm working on getting a good list on the back with the sponsers of the bills and their email address and also a couple of the local reps so people don't have to look for that info to contact their reps.

Thank you to all who are working on getting this info to as many people as possible. Having the info in front of them will make it a lot easier, having a brief summary of the bills and what they'll do is also very helpful. I haven't read them all, though I read enough to know they're all bad.

 

Several months ago I recall Blueberry (Bb), saying he got rick jones to admit something about the distribution system. They want control of it, Bb suspected it all along and got jones to admit it somehow. Now we're seeing it in print.

 

We see through their agendas, we see through their lies. I'm working on a letter, though I did already contribute one to the e-mail system for this next round of letters, I worked on the last one, too. It's the program that Bb and someone else set up for us, that's the one that goes out to 110 reps. That may be the one someone was asking about. Bb calls it the "Email-O'Matic." Some of us have written letters, which get put into that program, to be used as sample letters, they can also be customized. This helps people focus on the issue and helps those who may have trouble expressing their ideas in writing, in a way that's respectful and explains our side of the issue. Sure we have a lot to be angry about, but that anger can be expressed diplomatically and tactfully. It's a real challenge, but I love to write, so I always contribute letters. This will be ready to use by mid-August, I think. We want them sent before Sept. 7th. It wouldn't hurt to write them now, or call, too. If you don't like their response send them another letter. Most of them are so out of touch, it ain't funny. What we really need to do is try convincing enough of them that these laws will defy the voters' intent, and may even be unconstitutional. It'll hurt a lot of very sick people, who were given the right to use this medicine by 63% of the voters. This law, OUR law, is supposed to PROTECT US, not punish us. Had the law been properly IMPLEMENTED in the first place, these problems wouldn't exist. They're making any real problems seem like they're totally out of control, it's all being blown way out of proportion. It's THEM who want to control it, all they see is dollar signs. They need to know we are very serous about keeping the law as the voters intended, we have to pound them with our side of the issue- they're pounding us with their crap.

 

We are NOT a danger to children or anyone else, we are NOT criminals, we are law abiding citizens, NOT irresponsible, lazy, unorganized potheads. They do NOT see this as medicine, they're lumping us all together, claiming we're using it as an excuse to get high, claiming it's a back door way to get full legalization. The war on drugs, especially Cannabis, has failed. They make money keeping it illegal. Think of all the jobs created because of it. They don't wanna lose it, as if they'd be so poor they'd be unable to make a living. That's bullcrap. They make more than we'll ever see. They're greedy, selfish, insecure bullies and cowards. TRAITORS AND TYRANTS!

Please let's do all we can. Writing, calling, attending a rally, it's all part of it. At least do one thing, please. If we have thousands calling, etc., and thousands at the rally, we'll send a very powerful message that they cannot ignore- WE ARE WELL ORGANIZED AND SERIOUS ABOUT THIS LAW. It's OUR medicine, OUR rights, OUR law, and OUR community. Together we CAN make a difference.

They can't redefine the PHC to amend who can grow Marijuana under the MMMA of 2008. That would have no standing legally. The MMMA allows for caregivers to grow simple as that. SB618 has NO AUTHORITY to amend who can and can not grow under the MMMA of 2008. Did I miss a siffrent bill trying to get rid of caregivers by amending the MMMA? I remember reading about that before I thought....

It's so sad that anyone has to fear anyone, especially IF the govt were run by The People, For The People, etc. It seems it's always an "us vs them: situation. They made it that way, caused most of our problems. They got it all rigged against us, they need an enemy to justify their agendas.To me, it's obvious they're very disturbed, insecure beings. :(

 

Whoever votes for those bills, I'd like to see a list, and whoever votes against them, I'd like a list of them, too. We can thank the ones who opposed them, and write those who voted in favor to tell them they have lost our vote. Not only will they lose our vote, they'll also lose any votes of the others who voted for MM.
