Medical Marijuana Fac /ilities/Caregivers

Resoultion #2010-268A

 

 

Chapter 1286 General Industral District (GID) GID MAP

 

Section 1286.03 Uses Permited after Special Approval

 

(h) Medical Marijuana Facilities subject to the following conditions:

 

 

 

1. A minimum setback of 200 feet from all homes or residententally zoned dirstricts, adult regulated uses,

schools, churchs, child care facilities, parks, and drug free zones.

 

2. A state reestered and local business registration & specialty license is required for all facilities and primaary caregivers.

 

If the primary is noy the owner of the premises then consent must be obtained in writing from the property owner to ensure the

 

owner's knowledge of the use.

 

3. Consumption of marijuana on the premises is prohibited.

 

4. The location from which a primary caregiver manufactures, stores and distributes medical marijuana to a qualifying patient

 

shall not be used by another primary caregiver for any purpose whatsoever.

 

5. No more then 5 patients per caregiver. Each patient shall be limited to: 2.5 ounces of usable marijuana( excludes seeds,

 

stalks and roots) and 12 marijuana plants kept in an enclosed, locked ficility.

 

6. The facility shall be subject to inspections to confirm complaiance in accordance with applicable laws, including, but not

 

limited to, State Law, and City Ordinances.

 

7. Hours of operation primitted: M-F: 9:00 am-9:00pm; Sat.: 9:00 am- 6:00 pm: Sunday 10 am-6:00 pm

 

8. Minimum Distance from other similar uses: 200 feet.

 

9. Drive-through facilities shall be prohibitted.

 

10. Security: A security planshall be submitted for review and approval by the Planning Commission.

 

11. A conspicuous sign(s) shall be posted stating that " No Loitering is permitted" on such property.

 

12. Exterior lighting shall be required for security purposes, but in accordance with the provisions of the Zoning Ordinance.

 

 

 

 

Municipal Code 802.03 Compliance Required Prior to Issuance.

No License shall be granted or delivered until the applicant therefore has complied

with all the conditions precedent to it's issue

 

Licensing Fee $50.00 Submit Application only after Special Use Approval is granted by Planning Commission.

Whereas, the City of Lincoln Park has adopted from time to time certain ordinances and policies concerning various torms of licensing and

 

fees and Whereas, the Planning Commission has recommend amendments to the Zoning Ordinances to include Medical Marijuana regulations; that include a

 

required State Regestered and local business registration and specialty licencse for all facilities.

 

THEREFOR BE IT RESOLVED, that the User Fee schedule be amened to include a $ 50.00.

License fee for a Medical Marijuana facility per caregiver.

853.01 LICENSE REQUIRED.

 

No person shall assume responsibility as a primary caregiver for the purpose of the asquistion, possession, cultivation, manufacture, use,

 

internal possession, delivery,

transfur, ortransportation of marijuana or paraphernalia relating to the administration of marijuana to treat or alleviate a registed

 

qualifying patient's debilitating medical condition or systems, associated with the debilitating medical condition, as defined under the

 

Michigan Marijuana Act, P.A. 2008, as amended in the City without first obtaining a licnse from the city clerk.

 

853.02 STATE REGESTRATION REQUIRED

 

No License required by this Business Regulation and Taxation Code shall be issued to any person who is required to have a license or

 

regulation from the state untill such person submits evidance that he or she has secured said State Registration. A copy of which shall be

 

filed in the office of City Clerk along with their application.

 

853.03 LICENSE FEES.

 

Before any license required by this chapter is issued, the applicant shall pay to the City Treasure a non refundable fee, as set forth from

 

time to time by resolutio of Mayor and council.

 

 

853.04 LINCENSE EXPIRATION.

 

A License issued under this chapter shall expire at 12:00 midnight on the first Tuesday in Mayfollowing its issusnce, unless it expires at an

 

earlier date under the terms thereof.

 

854.99 PENALTY

This doc is subject to my poor typing skills.

As you can see it takes the right to medicate in ones home and prohibits it, and to cover the next base they add a fee?

Any ideals for getting this changed?

They are a joke no way anybodys coming into my home without a long drawn out legal fight . :thumbsu:

 

As it reads it is a attempt at continuing prohibition. It is sad that it reflects the lack of compassion and education in regards to the use of marijuana.

I have never been one for politics so any help and guidance would be appreciated.

There was this scum called Runco and he was in bed with the Lincoln Park Mayor and most of city counsel. He owns a lot of the properties off of Papalas Drive in LP, right of of I75, the behind the scenes plan was to pass city ordinance banning growing in homes. They wanted to force anyone wanting to grow meds into leasing properties that Runco owned or off to court you would go. They are strong arming the citizens by coming into homes of growers and taking everything and not pressing charges. Just trash the plants and destroy the equipment. It has happened to a few grower I know that USED to live in LP. These growers were careful and kept the numbers in order. Be very careful in that city as they are evil.

You do realise that the raided him and shut down his dispensery a little over a year ago. His brother is/or was a Judge in a northern county and here is some additional information of this fine upstanding gentleman...

After reviewing his record all I seen was ccw, cocaine and child support charges.

Ya that is him. He helped set up the current situation in LP and had to get out, something to do with Feds. Look at the Police blotter and see for yourself all the knock downs and no arrests. They are strong arming patients with pure intimidation. I know 2 cases personally and those 2 told of other knock downs happening. Zoning ordinances they drafted to monopolize and push the growers into leasing space owned by Runco.

What is the federal penalty for 23 grams of coke? last I heard it was like 20 yrs.

Hypothesis: What if the local yokel's with the insistence of the feds cut a deal for a minimum of 3 years in exchange for the creation of the current Ordnance?

Reading the ordnance is like reading some from a lawyer or a prosecutor.

 

I will be waiting for the various court rulings to be handed down then we will see where to go from there.

You got it. LP is messed up big time right now. The police force there is getting ugly. After messing around in LP,, Mr. Runco turned his attention to Romulus. He was trying hard to work his way into Romulus like LP. His connections got called out and his deal was off. and then he kind of just disappeared Hum? He pops up now and then to muddy up the waters!

And he sold me a clone infected with spidermites too! (I just thought I'd throw some more wood on the fire LOL).

 

When I met him a couple of years ago he said he had some connections in the East Detroit area and wanted to open up dispensaries on Gratiot.

First, take away our guns. Then have cities pass laws like this in Lincoln Park.

Then the State gives a list to LEO, who then can go from door to door.

 

The application I filled out and was approved for was for the legal possession of plants, in the state of Michigan.

Is Lincoln Park seceding from the State?

 

Section C of the application says it's required that I either had to name a CG, along with his/her info or name myself of the plant owner.

If neither box is checked, ownership of the plants defaults back to the applicant.

 

Fine and dandy. But I'm not growing and I don't need a CG. So as far as my city knows, I'm growing. And if they bust my door in, they won't find any growing going on. But they will have one heck of a lawsuit on their hands.

Was this on the news? Or in the paper? It seems like it would have been a pretty big story.

 

And how would they even get the names of people who are growing?

It's supposed to be confidential.

 

Giving a list to LEO is just flat-out wrong.

The more people who know where growing is going on just makes it more dangerous.

Getting raided (or even checked out) is one thing. But a criminal, who knows we're not allowed to have guns, would see us as easy marks.

No it was not in the news because its collusion or something and done behind the scenes. He was in the Mayors ear at that point in time. The LP police act on Tips! Then they come in and have a look. They do not want you to grow in your home and if tipped off they will be coming.

So....they find out about electric usage and use that as a tip? Nobody in the State is giving confidential information out?

I did Google this story and found a few, but it was a local paper, not the News or Free Press.

I would like to have the links to the stories. As I have had little time to dwell on this matter lately. It has occurred to me that the city of Lincoln park may have engaged in creating an illegal monopoly with the person in question. A Known felon at that! Sounds criminal to me.

 

Or they engaged in an effort to circumvent state law. Someplace there is some records of the counsels meetings that says who was there at the time this was passed. Can anyone say reco?

Runco is no longer working LP that I know of. But the mentality has carried on :angry: The club I used to belong to was very involved in the LP hearings. This is why I know this garbage as I attended and seen first hand what was happening. These shenanigans did not make much news at all because nothing was charged. All this activity was back room lobbying. Runco was trying to influence whoever would listen, for personal gain. You know these past few years have been hard on commercial properties, with the high vacancy issues, he needed to work a deal to herd growers into his vacant properties. But his plan would force the growers to locate in his commercial properties because of zoning and ordinance laws they were implementing or they were trying to implement. He planted the seed that is still growing today.

Your google-fu is weak my friend, try harder. There are litterly stories about this dirtbag all over the intrawebs. There are also a few threads on these boards about his foundation that he was running. Sending out letters to patients stating that they needed to come in for follow up exams or they would loose certification. Selling out of his home to anyone that had money. Raising Pit Bulls that attacked neighbors on several occasions (not on his property). Stories of his brother the former 19th Distict Justice that used his influence to pull strings for him. Charging new patients an additional fee so they could aquire meds before their 21 day waiting period, I could go on and on...
