Flint Medical Marijuana Dispensary Ordinance Changes Head Back To Planning Commission

Recommended Posts

FLINT, MI -- No one spoke up about proposed changes to the ordinance governing medical marijuana dispensaries in Flint during public hearings at Flint City Council on Monday, June 24.

And it didnât appear to matter â at least for now.

Council President Scott Kincaid told the public that city council wouldn't take any action following the mandated public hearings. The Flint Planning Commission will make a recommendation on the proposed changes and send the measure back to city council.

"Those actions will be taken by the emergency manager (Ed Kurtz)," Kincaid said of approving an potential changes to the ordinance. "It will be up to him to approve them."

Kincaid asked for public comment three different times during both of the hearings and no one spoke.

There are currently nine medical marijuana dispensaries throughout the city, according to city records. They include:

  • Michigan Compassion Care Center, 434 W. Water St.
  • The Green Bean 1625 W. Atherton Road
  • Michigan Safe-Transfer, 3401 Corunna Road
  • P2PMeds, 1011 S. Ballenger Highway
  • Memeâs Green Dream, 3600 S. Dort Highway, Suite 60
  • UGS Corp., 3316 S. Dort Highway
  • We Grow Education and Collective, 2849 Miller Road
  • Michigan Grow, LLC, 3553 S. Dort Highway
  • MI Organic Solutions, 3549 S. Dort Highway, Suite 106

City Attorney Peter Bade, who was not at Monday's meeting, said the city issued a moratorium on approving new dispensaries as Michigan's medical marijuana law is challenged in court.

Currently, medical marijuana dispensaries must be at least 500 feet away from any school, church or park.

"We have received some residential and neighborhood complaints," about current dispensaries, Bade told MLive-Flint Journal on Monday, June 24.

The current dispensaries that are not 1,000 feet away from a school, church or park will have at least 45 days to move if council approves the ordinance change.

Bade said there current marijuana dispensaries that will have to be, but did not know specifically which ones.

The city council voted 7-0 to postpone the amendment to the medical marijuana dispensary ordinance and the zoning restrictions that regulates the dispensaries.

sorry Bob, no matter how much you post, how hard you wish, or how often you cheerlead for dispensaries... they are all illegal... They have a bill pending that is not quite on life support, but it is close, perhaps you should change strategy on this and cheer for the Tigers.... they have a much better chance of winning.

Luckily our Flint friends have a friendly prosecutor.  It does not make them legal.

Anyone throwing away letters of warning and stating in public the police will never find the cash stashed at their house is a fool.  No more, no less.

Again i didn't post it because i am all for them or anything like that i stand neutral and as long as they write their own Law and leave our Law as it is am OK with that and i think most feel the same

IMHO things are as they  have always been farmers market, PC centers, C.C clubs, or  on a street conner  people our being helped

and thats the point Patients getting Meds

as you say No more No less

lol Bob, to suggest you are not a cheerleader for dispensaries, and have been, for several years, means I must suspend disbelief to believe you.

But if that is the case perhaps you could balance you posts that dwell endlessly on dispensaries with ones that suggest the caregiver system is healthy and effective.

balance would aid your desire to be neutral, 'cause bro to date you have not shown too much neutrality on this issue....

You've come a long way Bob, and it is good to see. Your understanding of the issues has vastly improved and your dedication is marvelous. Keep it up. Improved grammar and spelling are helping to make your posts more understandable and are beginning to lend you more authority. Those things will take you far.

Do you really think the owners of Clinical Relief are going to be able to keep a store open?  They may defend themselves successfully from charges, which is what the case is about, but they won't win their business back.  Even if they did, they can now be closed down under a public nuisance order.

McQueen at the Supreme Court level settled all of the issues of Clinical Relief from a law standpoint as to whether dispensaries are legal.  The court ruled definitively on that one.  Are you suggesting they will see the light on Clinical Relief

Remember, Clinical Relief was acquitted because the judge said the law was vague, no one knew exactly what was legal, and their local community endorsed their being in Ferndale.

We shall see if that argument prevails at the COA and perhaps later at the Supreme Court.  I would suggest they may prevail in getting out of the charges, but there is likely no freakin' way they are going to roll back McQueen because Clinical Relief is such a righteous case.
