Unfortunately the 10th Amendment doesn't cover this because the federal government already has a law in place that does.

 

If they are not given the power by the Constitution then it belongs to the State.

The Federal government was not given the power to regulate what you use for medicine by the constitution.

They merely declared it so without regard to the rights of the people.

The federal law that covers marijuana is the Controlled Substance Act.   As I said, the 10th Amendment doesn't apply here.  Wishful thinking though!

Where does the constitution empower them to create such a law? Controlling medical substances is not a power enumerated to the federal government. Therefore it is a power reserved to the states. Assuming you follow the constitution.

Who cares where I seen a six pound producing plant why is that troubling you? Why does it matter? I never said blow state laws out thewater, even thou the state of michigan hires pimps to be mayors.. I said why keep talking about whats law when your breaking the law. Some of you people are really sick in the head but its ok hopefully the meds help you out.

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations;

I'm not seeing the part about controlling what you put in your body.

Commerce also applies to production.  That's why you can't produce whiskey legally.

Will you explain that Celli? Are you saying that the Commerce Clause authorizes the Federal government to regulate the production of goods in this country? That either makes no sense or I'm misunderstanding you. Besides, the Commerce Clause has been so stretched beyond what the framers envisioned that it's become absurd. Under the current interpretation of the CC they think they can regulate just about anything. The Feds have been regulating drugs for decades, so I suppose there's something there in the constitution that they think gives them that authority.

Back to original topic, what's so wrong about growing in a basement? I would guess that the majority of us do just that. After all, growing is largely about controlling the environment. Besides, there are some very nice basements out there. Mine isn't very pretty, but some pretty good meds are produced down there.
