Police arrest driver in possession of marijuana

 

Richmond police were traveling in the southbound lane on Gratiot Avenue near Main Street on Sept. 10 at about 6 p.m. when the driver of a Ford Edge failed to yield before turning right from Main Street onto Gratiot Avenue, according to a police report. The officer driving had a solid green light when the other driver made a right turn directly in front of the patrol vehicle. The officer followed the vehicle through the intersection of Gratiot Avenue and 31 Mile Road. After passing the CVS on Gratiot Avenue, the officer turned on the emergency lights to make a traffic stop for disregarding the signal. The 37-year-old driver told police he knew he went through a red light and was in a hurry to get back home. As the driver provided his license, proof of insurance and registration, the officer could smell a strong odor of burnt marijuana coming from the vehicle. The driver told police his friends were smoking it earlier and that he was around them, which is why he smelled of the drug. When asked by the officer if he was in possession of marijuana, the man said there was a “one hitter” in the center console compartment in between the seats. The officer continued a search of the vehicle when backup arrived. The driver told the officer that a container may be found on the passenger side by the spare tire compartment and was from his “caregiver.” He also stated he has a medical marijuana card, but not in his possession because his wife does not approve of him using marijuana and burned it. The officer handcuffed the driver and placed him in the patrol vehicle. When the marijuana was found, the officer told the driver that he was being arrested at the time. The driver passed the Horizontal Gaze Nystagmus test and was permitted to follow the officer to the Richmond Police Department for fingerprinting. The officer completed a request to charge the driver due to the improper transport of marijuana being that it wasn’t in a locked compartment as specified in Michigan state law. The officer included a possession of marijuana charge due to the driver not having his LARA card.

I'm thinking once a drivers license is suspended the court also removes the ability to learn of other rules, like illegal transportation of marijuana? I wonder how they do that? I just heard that 7 of ten vehicles have contraband inside, so just pull over the bonehead looking ones first, and score 7 for the court! who needs to profile anymore, what a job! do cops get drug tested for employment purposes?

The county prosecutor reports that for the last fiscal year — which ran from Oct. 1, 2013, through Sept. 30, 2014 — his office prosecuted 842 cases involving marijuana charges in the following categories:

692 possession of marijuana

95 possession of marijuana with intent to deliver

55 improper transport of medical marijuana

 

Of all the criminal cases his office filed in that one-year span, McCoglan said, 18.17 percent included one of the charges listed above.

 

"So almost 20 percent of the cases we charged involved marijuana," he said.

Van Buren County Sheriffs Department To Seek Charges Against Driver Found With Marijuana

 

Police say that charges will be sought against a 21 year old man who was pulled over this week in Van Buren County and found to be in possession of marijuana. The Van Buren County Sheriffs Department says that a deputy pulled over the man's vehicle around 8:30 PM on Monday on 66th Avenue near 70th Street in Hartford Township. The deputy smelled a strong odor, and a search turned up about 48 grams of marijuana in individually wrapped packages. Turns out the driver had a medical marijuana card, but the sheriffs deputy seized the drugs as evidence, and charges of possession with intent to distribute marijuana and illegal transportation of medical marijuana are being requested from the Van Buren County Prosecutor's office.

if they were non-carded people, the charge should be plain possession (or possession AND illegal transport), which carries more fines and such.

some of these probably are regular people. 

 

i'm guessing the vast majority of them are registered patients or caregivers and maybe a few just didnt have the card on them at the time, or had expired cards.

 

but grassmatch, if you are curious, drop by your local courthouse and ask to see the records yourself.

Rochester man was ticketed for illegally transporting medical marijuana after a traffic stop at about 8:30 p.m. on Jan. 14.

 

The 23-year-old provided police with a medical marijuana card, but was told he was transporting his marijuana illegally.

 

Police found a marijuana pipe on the front passenger seat in addition to a container which the man told police contained marijuana before handing it to the officer.

 

An officer initiated a traffic stop near Ludlow and University Drive after the man was seen driving over a double-yellow lane line, according to police. The man was seen throwing a cigarette out the window of the vehicle as it came to a stop, police added.

 

The man was taken to the Rochester Police Department, booked and ticketed for possession of marijuana and drug paraphernalia before being released.

Card holder arrested

 

A Canton man with a medical marijuana card was arrested for improperly transporting marijuana.

 

The Northville Township Police stopped the man after midnight Jan. 12 after he did not stop at the flashing red light at Beck and Seven Mile roads after midnight. The police reported smelling marijuana inside the car and then spotted a pipe on the floor after a quick look inside. A further search turned up containers of marijuana inside the car as well.

 

The man did have a valid medical card, but because the marijuana was not in the trunk or in a container not accessible from the inside of the car, he was cited for a violation.

do you mean actively smoking in the car or they smoke in their car because they cant smoke in the house? so the car smells like old burnt marijuana?

 

so i'd say

actively smoking and driving: 5-10% . we'd see more duid charges imo if cops witnessed smoking in a car.

 

pipe or smokes in car but not while driving and car stinks: 10-70% . cops like to "sniff out" marijuana.

zap are you implying that some of these are lower charges to plead guilty to? so they were arrested with a higher charge (duid) and they plead to this instead? whats your guess on that percentage?

 

i mean, all of the full names of these defendants are in the newspaper links. it wouldnt take someone long to locate these people and ask them. or just check out the court records for full addresses.

 

i'm waiting for the right lawyer who will take these illegal transport cases and sue the courts for illegal prosecution and wrongful arrest etc.
