Medical Marijuana Dispensary Dismissal!

As of right now there is only one medical marijuana dispensary criminal case that has been outright dismissed without the possibility of the case being recharged, or of an

appeal reversing the dismissal decision – and that case is our case.

Unfortunately, per the agreement with the State, many of the details are sealed. However, I can divulge that our client was an owner and operator of a medical marijuana

dispensary in Southeastern Michigan. That dispensary was raided by police and ultimately our client was charged with felonies for distribution of marijuana.

We held the preliminary examination and ultimately, armed with the transcripts from that examination, we set about the task of writing nearly 100 pages of motions and

briefs.

As soon as we sent over the motions and briefs to the prosecutor’s office, they called us and waived the white flag. The case didn’t even get out of the District Court. No

appeals, no re-charging. Just the complete DISMISSAL of a felony case against a medical marijuana dispensary.

It will always be about the case and the law. There is no trick. If it was dismissed with prejudice at the district court, the police screwed up in some big way, most certainly.

I bet they do !  Cases are dismissed often because of police incompetence or malfeasance .

How about prosecutor malfeasance and incompetence? Like in the King case. They over reached in that case and it is hopefully going to come back and bite them where it hurts.

That is a great Question most Lawyers happen to work in said County and won't file a report against the prosecutor

dozens of disps opening in detroit every month, and every opener faces the same big question, how safe am i from prosecution?

it could be sobering to consider that no one has beaten a charge except by leo screw-up.

That is true they are awaiting a new trial but

 

they did have it dismissed IMHO that does count for something

That is a great Question most Lawyers happen to work in said County and won't file a report against the prosecutor  

Larry King said at one point that Jeffery Feiger had taken the case. I hope it has already been filed.

Don't get me wrong i hope he does sue the County but i just don't think it will every happen
