Quick Question.

See sec.8, re: Affirmative defense. It can be used in any prosecution regarding the medical use of marijuana, to include having more than one caregiver, and for that matter a caregiver having more than five patients, which can put you at risk and require you to use this costly means to stay out of jail if you are found out. Sec. 4 registration requirements, to include working with only one caregiver, are an entirely different animal. and the smarter and safer way to go. If you are comfortable with the risk, then the Affirmative Defense is an option.

your best option I believe is to grow your own 12 first, get your garden habits scheduled and consistent. Buy all of the equipment up front and control your atmosphere indoors. consider the strong odors that will be produced, lack of vacation time, floods, bugs, systemic pesticides, substrate disposal, nutrient handling, fire, mold, robbery, police, risks. Also know that your total legally produced cash will be dependent upon only five patients' monthly marijuana use. If they all use an ounce per month, and you collect 200 bucks per ounce, you'll get a whopping thousand dollars per month to spend, ....on your electric bill, packaging material, light bulbs, a new air conditioner, stink socks, seeds, delivery gasoline. still fun though, even though your labor is free.

welcome, enjoy!

One caregiver per patient, and either the patient or caregiver, but not both, possesses all the plants.  No sharing, no multiple caregivers.  A patient can obtain from anyone, but only the designated, registry associated caregiver has Section 4 immunity.  A case can be made for Section 8, but there is a very high burden of proof.  Don't assume because section 8 is out there, you will be able to use it in court or that it will protect you (this is on the caregiver end of the equation- they will be the ones trying to use section 8, not the patients).
