Rochester Planning Commission To Discuss Medical Marijuana Ordinance Tonight

The City of Rochester Planning Commission has a number of topics on its agenda for Monday, Aug. 4.

 

 

In addition to considering the draft of an ordinance amendment regarding the regulation of gas and oil wells, the group will be considering the draft of an ordinance amendment regarding a special exception use of medical marijuana.

 

 

Due to recent court decisions, state law and policies enacted by other communities, Rochester has decided to lift its moratorium on medicinal marijuana facilities, City Manager Jaymes Vettraino said.

 

 

But the city is going to great lengths to consider the future of the industry and its effects.

 

 

“We’re putting a high standard on these types of facilities,” Vettraino said. “This legislation is created to put all reasonable regulation and limitations on medical marijuana to make sure it’s done properly within state law.”

 

 

Vettraino noted the ordinance will not regulate the use of medical marijuana, which is governed by state and federal law.

 

 

The commission will be looking at which regulations to add to an ordinance while identifying the locales in the city which would be best suited for such a business. Vettraino sees the city’s south side as a potential target area.

 

 

Some of the businesses would be allowed to grow the substance, but they will not be permitted to dispense their product.

 

 

The facilities’ security and proximity to other businesses is another concern Vettraino said, adding there will likely be no limit to the number of medical marijuana facilities, but they should not be located in close distance to one another.

 

 

“We’re not too dissimilar to neighboring communities’ approach to medical marijuana,” he said.

 

 

He reiterated the ordinance is not the result of pressure from medical marijuana suppliers, but rather state and federal law which dictates cities must have a medical marijuana ordinance in place.

 

 

There will be “multiple opportunities” for public input on the topic, including at Monday’s meeting, Vettraino said. If the ordinance is approved by the planning commission, it will later have to be approved by the city council, where a public hearing would be required.
