Mmj Bills 5104 And 4271

Recommended Posts

my interpretation is that 5104 would do this:

1. all marijuana (bud and edibles) in public must be packaged and labelled. public means the road, but not your car. public roads, private cars. public means a park, but not a mcdonalds or a hotel or your friends house (all private property). although schuette tried to say that a hotel lobby was "public" , i think hes pretty brain-dead at this point. http://www.ag.state.mi.us/opinion/datafiles/2010s/op10340.htm

2. all marijuana edibles when not being made or consumed, must be packaged individually and labeled individually. no matter where the edibles are, public or private.

3. patient 2 patient transfers would be a felony under the MMMA. section 8 applies still.

4. caregiver 2 unregistered patient or caregiver 2 caregiver would be a felony. section 8 applies still.

can someone explain how 5104 breaks sec8 protections for unregistered patients? i think i heard someone say that but i dont see it with my lying eyes.

(O) EACH OF THE FOLLOWING IS A FELONY PUNISHABLE BY
IMPRISONMENT FOR NOT MORE THAN 2 YEARS, A FINE OF UP TO $2,000.00,
OR BOTH:

(1) A QUALIFYING PATIENT SHALL NOT TRANSFER A MARIHUANA-
INFUSED PRODUCT TO ANY INDIVIDUAL.

(2) A REGISTERED CAREGIVER SHALL NOT TRANSFER A MARIHUANA-
INFUSED PRODUCT TO ANY INDIVIDUAL WHO IS NOT A QUALIFYING PATIENT
TO WHOM HE OR SHE IS CONNECTED THROUGH THE DEPARTMENT'S
REGISTRATION PROCESS.

(3) A MEDICAL MARIHUANA PROVISIONING CENTER SHALL NOT TRANSFER
A MARIHUANA-INFUSED PRODUCT TO ANY INDIVIDUAL WHO IS NOT A
QUALIFYING PATIENT OR REGISTERED CAREGIVER.

Robertou812, this is good. Sen. Meekhof needs all the encouragement we can send him. His is my Sen. and I not real happy with him in general. Case in point. I wrote him a very courteous and sincere letter earlier this year when it looked like the Senate might vote on these bills. His response: Nada. Not even a form letter reply. I'm going to try again and call his office. Not holding my breath.

Sometime when I write letters to Senator, I ask them to respond in writing.  I think they are obligated to respond if you request it.

I hear that quite often and I also vacillate each time my card comes up for renewal.

This is my simple logic for remaining registered;

I am a cannabis user who voted for our MMMP and feel that by keeping my card up

to date, I continue to support my vote, the program and all other pt's/ cg's by doing so.

Secondly, my card allows me access to card holder only events/ gatherings/ markets etc...

I won't give that up either.
