Insurer Wins Suit Over Fire, Pot In Bay City Basement

Recommended Posts

In my experience insurance is fine until you have to make a claim.

Or miss a payment.

Consider the chainsaw tree mistake; drop a tree on your roof and they'd pay, right?

But if you were an MMJ patient and admitted you had medicated just prior to firing up the old Stihl, maybe not.

And if they paid first and then found out you were an MMJ patient and took you to court, who do you think the judge would rule in favor of?

It is truly ironic. So many bleeding hearts think blacks and minorities are discriminated against.

Nobody has it worse than an MMJ patient. We are the most discriminated minority in Amerika.

The Insurance Company denied the claim because "Nationwide Mutual Fire Insurance said the insurance policy was violated because it wasn’t informed about the basement nursery."

The presence of the nursery does not appear to contribute to the fire. If they want to say there was no rider for the additional equipment which was not covered under the existing homeowner's declaration then that is reasonable. Declaring an entire homeowner's policy null and void because of the presence of extra equipment is an error. If the lights or aspect of the growing room didn't contribute to the fire then its presence is immaterial. If there was an antique hutch in the basement that went up in flames and was worth 20k but was undeclared the Insurance company would have the same complaint.

The Insurance company seems to be saying the presence of marijuana means the house was not insurable on a Federal level. That would make the entire mortgage underwriting suspect for every grower in the country. The can of worms opened here is immense.

The Butane is a head shaker but not really the story. Denial of Insurance coverage at the most critical time is the debate. I hope this case isn't over because this is a terrible far-reaching decision as it stands.

The COA has ruled that way in this case. They are really hatin' on us lately. In fact, just about any state official or political wanna be can use us for traction as they publicly kick us. It's like; "You want to get yourself a little public relations improvement then go and kick some pot heads publicly and you rise in the polls."

Just like what Snyder did with his BS wise cracker lies about the pot plantation in the dorm room.
