What did Badovinac say that is clueless or ill-informed?

 

His stance is one of the most reasonable that one can expect from a prosecutor.  He isn't ranting against MJ and even implies that it will eventually be legal. He explains that the law is confusing and that he is sympathetic towards medical use, and supports local growers of cannabis especially versus big pharma. He says that he's going to leave legal users & caregivers alone.

 

His understanding of dispensaries is pretty mainstream, and indeed meshes with the opinions of many people on the forums here: that the current wording of the MMMA does not allow for dispensaries except if they are designated caregivers for the customer, and that it isn't an economically feasible business model.

Since when do employees, time and labor not count as costs?

 

MMMA: 4(e) “A registered primary caregiver may receive compensation for costs associated with assisting a registered qualifying patient in the medical use of marihuana. Any such compensation shall not constitute the sale of controlled substances.”

 

Definition of compensation: “the act or state of compensating, as by rewarding someone for service or by making up for someone's loss, damage, or injury by giving the injured party an appropriate benefit. ”

 

Definition of cost: “an outlay or expenditure of money, time, labor, trouble, etc.”

 

Anthony Badovinac: “But my job is to uphold the law.”

 

No, your job is to first understand the law and then to uphold it Mr. Badovinac. Apparently to him... time, employees and wages are not a cost of doing business. Under the same logic, we should no longer be paying him for his services.
