In A Bit Of A Pickle, Any Advise Please?

hello all...i have a friend who is medical........NOW......but is not a member here so i asked him to explain the situation and i would post it for him....ANY ideas would be great!!! you guys rock!! thank you soo much

On May 28 2010, the Friday before Memorial Day, I was arrested for

DWLS by the South Lyon Police Department. During a search of my

personal effects police discovered ¼ oz. of marijuana. At this time I

was not enrolled in the MMMP. I was diagnosed with IBS in 2005 and

later Crohn’s. On August 11 I applied for the card. I still have not

received the physical card.

I never received any court date or summons on this arrest. I was

moving the weekend that I was arrested but I did give the police my

new address. To date there has been no explanation why I never

received a summons.

On October 29 I called the police because a man was threatening me

with a gun in a parking lot over, of all things, a parking space.

When police arrived they discovered that I had an outstanding warrant

for possession and DWLS. My traffic tickets had been paid by that

time. I told the police I was enrolled in the MMMP. I was taken to

jail and arraigned the next day. At the arraignment the judge set

bond at $1000 RO with conditional drug and alcohol testing. I don’t

drink so that isn’t the issue.

What I need to know is when will I be able to resume my medication

regimen. It has been several days and I have had to submit to two

random drug tests so far which I am certain I failed as I have been a

daily smoker for the last 4+ years. I am afraid to use my medicine

and possibly face additional charges or the revocation of my bond.

That said, the amount of physical pain that I am in is becoming

unmanageable.

Can anybody offer any advise?

Might as well continue medicating....you're already 'caught' and it can't get any worse if you continue. Is it just one of the tests that checks for 3 substances or do they check tch levels? That would probably effect my decision.

 

hmm i might have heard him say something about getting his levels down....but who's to say what "level" is therapeutic from one patient to the next? hmmmm

Your situation is entirely up to the nice man in the black robe and the prosecutor. As for all the talk about THC levels rising or falling it is pointless. They will just adjourn and retest if they are concerned. It is possible they will not catch the fact that you were not in the MMMA at the time of the arrest and seizure and it is not clear how the court's will ultimately rule on the issue.

 

This actually sounds like an opportunity for a very nice plea deal. Maybe 6 months on a 7411 that lets you use your meds and you waive the affirmative defense? That way the courts get money and you get your freedom and no record. Only works if you already have no record...just winging it for post number 200.... :rolleyes:
