THE CITY OF ROCHESTER HEREBY ORDAINS:
Sec. 32-467. – Definitions.
The following words, terms and phrases, when used in this division, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Marihuanameans all parts of the plant Cannabis sativa L., growing or not; the seeds thereof;
the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative,
mixture, or preparation of the plant or its seeds or resin. The term does not include the mature
stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any
other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, except
the resin extracted therefrom, fiber, oil or cake, or the sterilized seed of the plant which is incapable
of germination.
Usable marihuanameans usable marihuana as defined in Section 26423 of the Public
Health Code, MCL §333.26423 as the dried leaves and flowers of the marihuana plant, and any
mixture or preparation of the dried leaves and flowers. Usable marihuana does not include the
seeds, stalks, or roots of the plant.
Useshall include the holding, possessing, inhaling, smoking, and/or consuming with the
intent of introducing into the human body for an individual's personal experience.
Sec. 32-469. - Possession, Transport of Usable Marihuana in or Upon a Motor Vehicle or
Self-Propelled Vehicle
A person shall not transport or possess usable marihuana in or upon a motor vehicle or any
self-propelled vehicle designed for land travel unless the usable marihuana is 1 or more of the
following:
(1) Enclosed in a case that is carried in the trunk of the vehicle.
(2) Enclosed in a case that is not readily accessible from the interior of the vehicle, if
the vehicle in which the person is traveling does not have a trunk.
Sec. 32-470. - Penalty for violation of division.
A person who violates this division is guilty of a misdemeanor punishable by imprisonment
for not more than 93 days, or a fine of not more than $500.00, or both.
This ordinance shall become effective immediately upon passage and publication.
A true copy of this ordinance may be purchased or inspected at the office of the City Clerk at the
Rochester Municipal Building, 400 Sixth Street, Rochester, Michigan, 48307, during regular
business hours, 8:00 a.m. to 5:00 p.m. daily, except weekends and holidays.
