12 plants for each patient=60 plants plus 12 more if caregiver is a patient=72 plants. 99 plants and over become Federal jurisdiction. Clones may or may not count depending on the a.s.s.-clown LEO that wants to make an example of you...

Hehe, there is no easy answer to give ya on that question.

 

State law allows for the 12 plants per patient, so yeah technically you could have 144 plants growing between the 2 of you.

 

That is where it gets into the tricky thick of it. As federal law has some nasty penalties that kick in at various levels of plant possession. At 50 plants you trigger the up to 20 years in jail and a fine of $1 million if an individual, $5 million if other than an individual. At 100 plants you kick in the mandatory minimum of not less than 5 years, not more than 40 years, and a fine of not more than $2 million if an individual, $5 million if other than an individual.

 

So the question for you to answer for yourself is, whether it is worth entering that territory with the feds, and or raising that much attention for yourself and wife by having a grow of over 100 plants...

Question: If a husband and wife both have there cards and plan to each be a caregiver for 5 other card holders for a total of 12 legal card holders how many plants can they have at there residince is it 12 for each card holder or is there a limit

the husband can grow 12 plants for him self and 12 plants for each patient that is up to 5 so the husband can tend 72 plants total and that will be very hard and very costly to do at one time the wife can do the same thing so thats 144 all together no law agenst that as long as all the cards mach up there is no law on limits per residince but if this is your first grow you should take it slow and grow for your self first see how it grows before you expand 24 plants is alot of work and take up alot of space good luck stay legal

This is not accurate. The feds have penalties all the way down to 1 plant. However it is just not likely for them to enforce that part of it because of the resources it takes to prosecute, and because the small chance of jail time on a first time offender in the very low levels of grows isn't worth it.

 

This is for a first offense under Federal jurisdiction...

Marijuana 1 to 49 plants = Not more than 5 years, Fine not more than $250,000, $1 million other than individual.
