Tonight at 7 ..

 

To the Ann Arbor City Council.

 

Many elements of our new medical marijuana law have not yet been tested in court.

 

One such area is the confidentiality rights listed in the law.

 

These rights have protections that include criminal penalties for employees of local units of government that violate those protections.

 

The city of Ann Arbor is in the process of passing a law that may require it’s employees to commit a crime as a part of their work.

 

No one has consulted with these employees to determine if it is a risk they wish to assume.

 

It seems reasonable to talk to those about to take these risks before, rather than after, one of them gets arrested.

 

The section of law is 333.26426 (h) (4)

 

The MDCH rule on the topic is 333.121

Thanks PB. I was wondering how Ann Arbor and Ypsilanti plan to enforce registration or any other of the new requirements. Fines? Ypsilanti has said you will have to register and provide records and allow police officers into your grow!

 

Simply providing the name of a medical marijuana patient to the person behind the desk is likely a violation of criminal law. If not a violation of criminal law, it requires the submitting person to waive rights that have been granted by Michigan voters.

 

I guess you could say that state rights and protections have been declared null and void in that local location.
