trix
Ok I've been requested by a Family member to find legal advise. I hope she gets the answer she deserves.. Here is the situation, This family member has worked with Motor city casino since opening day way back when, she suffers great pain daily. She has several qualifying conditions, But is so scared of getting fired from her job!! she has lost her home already and will lose everything if she losses her job to.. so she is reaching out to me to show her something saying it wont happen, she won't lose her job... OOHH yeah, and she is a Royal Oak resident as well, just watched a town hall meeting and that alone is a bad thing. more worried about her job. Anyone work for the Casino, do you have your card. She wanted to know does it matter that she is Union, does that give her any protection? is one Union better than the other at rights and what not? I just know how it feels to be afraid, and it hurts me to see my family in pain, when there is relief.. As I typed that I reread it out loud and I bet she won't get what shes looking for, and will live in fear and will eventually ruin her body, and lose her job in the end anyways. and if she could smoke she may have a better future, and last longer in her career.. To me I think this could fall under the Walmart case, or the U.N. LEO case (emann), but is a Union job like Motor City Casino considered at will employment? or any different than the police Union, or the Automotive Union, all the same rights across the board? or job depending? Do you guys get what I'm asking? Thanks in advance, Trix
Big Smoke Dog
The Big 3 downtown were granted their licenses from the Michigan Gambling Board or commission or what not, at least that I know of. Unless they have some sort of hidden government funding (which I cant possibly see happening at a casino owned by Ilitch and part of a UNION aka Detroits Criminal Underground.), I dont think they have to comply with federal statute like the Indian reserves do. Although they could pull a Walmart and say "NO! YOURE FIRED!". Motor City is touchy. I've went there 1,000 times flawlessly. But theres always a time or two that they deny entry due to your ID being slightly bent, etc. So I'm sure they'll pull the douche card on this one. And if she gets lucky, and they didnt, you best believe that they're going to pull the douche card on her as soon as she makes someone there mad. Do they do random screens at motor city or only if you get hurt? It's unfortunate, but it's how I've always stayed off the radar.
solabeirtan
I quit punching a clock a couple decades back. NAFTA etc. Dont know how they ever managed to pull that one off. Oh, I see: they waited till I turned my back and wasn't looking. That crap isnt legal. Maybe required if you are in charge of peoples safety, like a pilot, or ???? You would go nuts their being high and listening to that " Twilight Zone " musak they pump out. I cant stay inside there more than a hour. Light weight I guess. LITLJON
How's Trix, IMO Your friend needs to talk to Her Unions Law Dept. fair question for someone with MS. I don't think it would raise flags.
Ionic7
There is no law protecting employees been covered many times, it is more or less up to the employer
lawyercaregiver
Ionic answered the question. Komorn might disagree but I think it is up to the employer exclusively. You should check with your Union and/or benefits office if there is a question about drug testing. Most employers only drug test at the entrance interview and don't do the random drug testing. Your employer may or may not care if you test positive for cannabis and may or may not care if you have your medical card. So find out what your contract says about drug testing and/or medical marijuana policy. Now if you are just scared to get the card (and presumably are smoking marijuana anyway) because you are worried about your employer finding out or being contacted by somebody like law enforcement then I think that is ridiculous. Supposedly your confidentiality is protected by the State licensing agency.
