The federal workplace drug testing guidelines, revised and released by the Substance Abuse and Mental Health Services Administration (SAMHSA), Department of Health and Human Services (HHS), aim to clarify that individuals using medical marijuana under a doctor’s recommendation in a legal state cannot use it as a valid reason for a positive THC test.

In its recent notices published in the Federal Register, SAMHSA has made an important announcement regarding the amended guidance for saliva and urine testing. Notably, this update includes a cannabis policy clarification, despite the organization receiving comments opposing the proposal after its initial announcement last year.

In the new notices, SAMHSA acknowledges receiving numerous comments urging reconsideration of the marijuana testing policy, with many advocating for federal cannabis legalization. However, the agency asserts that the revised guidance aligns with existing laws.
