House committee to host hearings on medical marijuana bills

 

 

Lawmakers are to hear today from a string of speakers with concerns about four bills to change Michigan's law allowing medical pot.

 

At hearings of the House Judiciary Committee, lawmakers are to hear comments from key groups, including associations of patients, compassion clubs, the American Civil Liberties Union, the Michigan State Medical Society and Michigan State Police, according to a roster assembled Wednesday by the office of state Sen. John Walsh, R-Livonia, chairman of the committee.

 

At second hearing March 8, "we'll hear from individuals -- anyone who wants to speak," Walsh said last week.

 

"The fear is, we're going to gut the medical marijuana act. That never was our intention," Walsh said. "We're just trying to make it a better law for everybody -- patients, caregivers, law enforcement, our zoning administrators and doctors."

 

House Bill 4834 aims to speed up issuance of ID cards for patients and caregivers, and it would give police access to the registry -- an invitation to drug busts, say some defense lawyers.

 

HB 4851 would require more careful exams from doctors who certify patients and clarify what is an allowed spot for growing pot.

 

HB 4853 would clarify sentencing guidelines for violations of the state medical marijuana act. HB 4856 would make transporting medical marijuana similar to transporting a gun and would make it illegal to operate a vehicle, plane or motorboat while under the influence of marijuana.

 

Although Republicans typically oppose wider access to medical marijuana, with Democrats split on the issue, the bills will need bipartisan support because they must pass with three-quarter super majorities -- required to revise any constitutional amendment such as the Michigan Medical Marihuana Act, passed by state voters in 2008.

 

One committee member -- state Rep. Phil Cavanagh, D-Redford Township -- is sponsor of the bill that would require a good-faith relationship between doctor and patient before someone could be approved for medical marijuana use.

 

Cavanagh said months of research showed him that medical marijuana could take the place of prescription painkillers that have harmful side effects.

 

"I have real concerns that medical marijuana patients aren't pushed toward unwanted prosecution or harassment," he said. Cavanagh's amendment, added at last week's hearing -- to let medical marijuana users who are being charged with a crime declare their health status in court -- passed 15-0, he said.

 

The Southfield-based, 26,000-member Michigan Medical Marijuana Association is leery of all four bills, said the group's attorney, Michael Komorn, who is to speak today.

 

"None of these bills address ways to protect patients or caregivers from arrest and prosecution," Komorn said.

 

But Tim Beck, co-founder of Coalition for a Safer Detroit -- which favors limited legalization of pot -- said he attended last week's hearing and feels that the bills "will clarify problematic areas in the current law."

Today's hearing in Lansing, 10 a.m.-noon in Room 519 of the House Office Building (124 N. Capitol Ave.), is for interest groups including the State Police and medical marijuana organizations.

 

But individuals can speak at next Thursday's hearing, also 10 a.m.-noon and in the same location. The hearings are on four bills to revise the Michigan Medical Marihuana Act.

you know what, I'm about as right wing as they come too, but I am a mmmj patient. My family Dr is about as right wing as they come and she signed my original paperwork. Who exactly are you gonna complain about if a bunch of people cross the isles and push through these new amendments? That is one main reason I don't post much, or read much on here. I'm truly sick and tired of hearing people constantly bashing the right. You don't see me on here talking about welfare pimp gun grabbing baby killers do you? I am proud to be a conservative. I am proud to be an American.

Well when the right starts caring about the people and not corporations then I might think about it . Romeny sure as heck doesn't support us that's for sure . Today GOP is not what it used to be . The word compromise is like the forbidden word now days . Instead we have to deal with stuff that doesn't matter like contraceptive medicine then focusing on real issues. Medical marijuana could be a great rescue . Look at the money generating from this . Taxes are being paid everywhere and if Romney gets in you better believe it will all be over with . I also feel marijuana should be able to be used by anyone . Medical or not . Paul is the only one out there who supports this but I feel Paul is just to far out there for todays society . Wasn't putting you down just stating the obvious the Detroit news is definitely more right . And I know plenty of conservatives who laugh at my story when I tell them I am free of legal opiates but use medical cannabis .. our priest said he would pray for me.... I told him them were others who needed it more not to waste it on me that god already provided me .

The only doctors that "have treated or consulted with respect to the patient's debilitating medical condition for a reason other than the patient's application or intended application" are unable to certify anyone because of administrative rules at their practices/hospitals that FORBID them from certifying ANYONE for ANY reason, including terminal cancer patients and those dying from wasting syndrome from AIDS. :growl: :growl: :growl:

Why do we frequently bash the right? Because the vast majority on the right are against mmj and tend to be hateful, judgmental, closed minded people who agitate for war and slashing of social services, abandoning the sick and the poor to the elements, eager to take food off someone's table so it may be burned in the engine of a giant yacht.

that wording has been changed Purk.... it is more inline with the recent MBOM memo on the term bona fide now. unsure on how the psychological exam is allowable.. but presume it was offered as something to sacrifice prior to passing forward out of Committee.

This throws all kinds of what could be potentially bad things in the mix.

 

On the part that talks about enclosed areas does this mean if the wording is changed it can be grown outdoors as long as it is in a locked area? Sure would save some cash on the ole electric bill.
