Need Help For Caregiver Co-Op

The only legal transfer that has Section 4 protection according to the Michigan Supreme Court is between a registered caregiver and his registered patient.  If your "network/co-op/group" goes beyond that, they would be breaking the law.  There are a few things below that still fall into grey areas that can get you arrested that you might be able to beat in court later.  I've written this list conservatively to keep people out of a jail cell.  Section 8 can always be used as a last ditch defense.

 

Some things to consider:

 

1)It's not legal for caregivers to access each others grow.  Even if they are husband and wife, they must have separate, locked enclosed areas if they are both caregivers.

 

2)While a patient can get MMJ from any caregiver, a caregiver is not allowed to transfer to any registered patient, only to his registered patients.

 

3)A caregiver is not allowed to transfer to other caregivers.

 

4)"Daisy chains" (A caregiver selling to a patient that is also a caregiver who then sells that medicine to another patient, who's also a caregiver who can now sell that medicine to another patient/caregiver, ad infinitum.) while technically legal is also legally risky.  It would not be legal for a caregiver to knowingly transfer medicine to a patient that was passing it on to someone else.  If it could be proven that he knew then there are three people involved and the darn LEOs can add conspiracy charges on to anything else they arrest you for.  If you think conspiracy charges are far-fetched, ask Ryan Basore.  He just got four years for conspiracy on top of four that he got for trafficking charges.  Now on the other hand, it's almost impossible to prove that somebody knew something without the person confessing.  So, keep your mouth shut at all times, including while posting on an internet forum.

 

Well, sadly, there needs to be some additional qualification to your very-good post.  Especially regarding daisy chains (As an aside, Ill put in that "daisy-chain" had its own meaning years ago (see 70s porn) 

 

For those who followed the Mcqueen case from start to finish, you will see how SC Justice Roberts asks (more or less) "How is the seller's/giver's pain alleviated when he transfers MMJ to someone else?"

What if the greenhouse was sectioned off to each caregiver? Each section could only be accessed by a specific CG. Like a different locked entry for each section and each CG has their own key. 

 

I am not for something like this, and I am not sure if it is entirely legal, and of course it is asking for it. Just growing outside is asking for some form of harassment. I guess in some cases something like this is needed, a coop type of set up. Since our government is breaking their own laws by not allowing growers to grow in certain cities and so on. I suppose since it is almost impossible to sell your house and move to a location to where you can grow, I guess your only alternative would be a coop type set up on someone elses land, like renting a place to grow.

 

Realistically, I felt safer before I became "legal".

 

However, this is just my opinion, I am not gong to continuously re-post and stuff my political views down somebody's throat. There are many web forums that would not tolerate that kind of behavior. It would be more prudent to ask questions before making assumptions.

 

To be fair, everyone is entitled to their own opinion and interpretation of the law. However, it is each citizen's responsibility to stay within the parameters of the law.

Every cg commits a crime when they acquire genetics?


(i) A person shall not be subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege, including but not limited to civil penalty or disciplinary action by a business or occupational or professional licensing board or bureau, solely

for being in the presence or vicinity of the medical use of marihuana in accordance with this act <--------(maybe this is supposed to act as a screen shielding the supplier from being "seen" legally? Perhaps this is the magic 'nowhere' that patients are supposed to get seeds/clones/meds from the first 3 months if they want to be their own cg? )-------,

or for assisting a registered qualifying patient with using or administering marihuana.
