Warren Schedules Public Hearing On Medical Marijuana Law

The Warren City Council has scheduled a Nov. 10 public hearing date to accept comments from the public concerning Mayor James Fouts’ proposed ordinance regulating medical marijuana.

 

 

The mayor wants to establish more specific regulations for the growth and storage of the drug for medicinal purposes, including building inspections and filtration systems to block the pungent odor of marijuana from reaching outside.

 

 

“The bottom line is I want to stop de-facto commercial operations from popping up in residential neighborhoods,” Fouts said Wednesday. “We are not trying to deprive anyone of medical marijuana.”

 

 

Fouts had the city’s legal department draw up the proposed set of regulations largely in response to a Sept. 28 explosion and house fire where marijuana was being grown on Harold Street that investigators say was caused by the use of highly flammable butane and alcohol to extract oil from pot plants.

The mayor is also concerned about medical marijuana caregivers -- licensed or illegitimate -- setting up shop in residential areas that could become magnets for burglaries and often release odors that offend their neighbors.

 

 

Some highlights include:

• Anyone wanting to grow marijuana must register with the city. If approved, energy use and heat levels in the growing room must be documented

 

 

• A filtration system must be installed to block to odors emanating outdoors

 

 

• Inside a vehicle, medical marijuana could only be transported in a locked case

 

 

Fouts also would like to set up a specific section of the city instead of having them scattered around the community, but that’s part of a separate ordinance.

 

 

The City Council on Tuesday night approved the first reading of the ordinance and scheduled the public hearing for next month.

 

 

Council President Cecil St. Pierre said he anticipates the ordinance will be approved.

 

 

“Nobody has any problem with clean air,” he said. “Some of my colleagues have received complaints regarding the smell coming from some of these homes, so we’re going to look at what the mayor has proposed. We definitely will research it carefully and give it all of the consideration it deserves.”

 

 

The move comes as former Warren Deputy Mayor Michael Greiner has filed a $5 million lawsuit on behalf of two dozen medical marijuana patients who claim the city and its police department are trying to block the sale of the drug and harassing caregivers and their patients.

 

 

The suit is pending in Macomb County Circuit Court.
