Detroit Police At It Again

On the night of March 6, 2010, myself & 10-12 of my family members were celebrating my 30th birthday at “Amnesia“. I reserved a V.I.P. table w/bottle service & I also hired All-American Limo to transport us to the club. When we arrived at the club, we were taken upstairs to our table & seated. Most of our night was spent in the V.I.P. area having drinks & celebrating. The only time anyone in our group really left our area was to use the restroom. At the end of the night, I made my way downstairs with one of my cousins to wait for the rest of our group. While we were standing in the lobby area of the club, one of the security guards approached us & told us we had to leave. We tried explaining to him that we were just waiting for our party to come downstairs so we could make our way to the limo, but he continued to give us an attitude about standing there. The security guard then proceeded to tell us that he smelled marijuana & asked which one of us had it in our possession. I replied that I had some “medical cannabis” in my pocket, along with my “medical” card. At this point, he instructed us that we needed to come with him. Not wanting to cause any trouble, we followed him. During our walk to the detainment area, I informed the guard repeatedly that I was a legal “medical” cannabis patient & that I had the necessary documentation to prove it. Once I was in the detainment area, I handed over my meds & my medical card to one of the guards. While I was waiting for a Supervisor to come speak to me, another security guard began to verbally assault me. He repeatedly told me that I needed to “sit the flower down & shut the flower up”. After his orders were ignored, he then proceeded to physically assault me by pushing me backwards into a conference room. At this point, I asked if he was allowed to put his hands on me & if I could be physically restrained if I tried to leave? Once I was informed that the guards are not allowed to physically touch you, I made my way out of the conference room & headed for the door that lead back to the gaming floor. Before I made my way through the exit door, I asked for my “meds” & my “medical card”. I was told I couldn’t have either item. After being told I couldn’t have my property, the same guard who had previously assaulted, once again shoved me. This time, I fell through the door to the gaming floor on my back & was immediately restrained by numerous Casino guards. This was all witnessed by numerous members of my party & other Casino patrons. In no way & at no time during this altercation did I resist or struggle. Once I was face-down & handcuffed, I was taken back into the detainment area & placed in a cell. While in the cell, one of the Casino security supervisors came in & removed my handcuffs & gave me a bottle of water. I told him that I wanted the cops called immediately. After some time, two DPD officers arrived & informed me that my “medical” card was not valid in the State of MI & that I was in violation of the “Controlled Substance “ Act. I was also informed that the $2600 I had in my possession was also going to be seized. Once the officers were ready to leave, I was placed in handcuffs & walked through the casino to the parking garage. After being placed in the back of the squad car, I continued to ask the passenger seat officer why I was being taken to jail? He repeatedly told me to “shut the flower up, or he would shut me up”. I continued talking. Before we even made it out of the the parking garage, the passenger seat officer instructed the officer who was driving to stop the car. He then proceeded to get out of the car & came into the back seat & was hitting & choking me. All while telling me to shut my mouth. I continued talking. After our “incident”, we made our way to the 11th Precinct. Once we arrived at the jail, I was placed in a holding cell & kept there until Tuesday. At no time was I read my rights, nor was I given access to an attorney. I was also never informed of why I was there, or when I would be released. After three days, I was taken to the Courthouse downtown & told that they “lost” my paperwork & I was escorted to a side door & released.

For a minute there I thought I was dreaming or that you were a spam bot but I am wrong on both counts! I knew I heard this story somewhere before. Welcome to the site. Sorry you had to go thru this ordeal. Do you plan on suing the club and/or their security for their actions as well as LE? I wouldn't take this sitting down. Its time to rise up and fight back. I know easier said than done but they need to be made an example out of. Hopefully with enough lawsuits fighting back against them and we can stop this cycle or derail it off the nearest cliff. I would also make a police report for robbery and contact the higher ups in your city. I would also go even more public with this and contact your local media. Make some noise. Is there anything anyone can do to help? You have the support and I am confident you will have support in that court room if you so choose to take a stance on behalf of yourself and every patient and caregiver in the United States as well as everyone who supports and believes in this cause. Not to mention those against violence and the abuse handed to us by those who are meant to protect and serve. Are you still a resident in North Cali or do you reside here in Michigan now? Welcome and sorry your experience here in Michigan hasn't been more pleasant. These thugs are an embarrassment and they will pay somehow, someway, someday, I promise you.

WTF...DPD wasted timne on something minor like this..???I am in amazement....how bad were you running off at the mouth. I have never had a DPD officer of any unit ever give me any trouble. I give them respect and they are very reasonable. These cops see killers everyday. If your calm and collective they never arrest because they literally have so many big fish to fry.

I give them respect and they are very reasonable. These cops see killers everyday. If your calm and collective they never arrest because they literally have so many big fish to fry.

...the only running at the mouth i had to do was say i had $2600 in my pocket...and i have never had an encounter like this with DPD before, either...they usually do have bigger fish to fry, but this fish had a pocket full of cash...the best part of this story is that the day after i was released, i got pulled over in my hometown for expired tabs & once again i had my meds on me...the officer who pulled me over knew i had my card & asked if i had any cannabis in the vehicle...i told him i did & he said he was just checking...didn't give me a hard time at all...when i told him what i had just gone thru, he didn't believe me at first...

i didn't really offer the info, but they asked if i had anything else in my pockets & i def. wasn't smoking anything...i had some SUPER stinky sour "d" in my pocket & the security guard was right up on us when he kept hassling us to move...the entire incident was just one big shake-down...the guard saw an opportunity to swipe some dank meds & DPD just wanted that $$$...i guarantee that if i hadn't of had that amount of money on me, i wouldn't have went thru what i did...

It might be possible to file criminal charges against the security people.

 

Armed with tazers, pepper spray or a baseball bat .. armed period.

the only bad thing is , he is most likely on disabilaty, and can not afford the #00.00 a hour for a good lawyer..So he might have to take this sitting down.

just to clarify a couple things...i am not on disability, nor do i plan on taking this sitting down...i am actually a 30 yr. old, white male who owns & operates a Medical Marijuana Consulting Firm...i was born & raised in MI, but i now spend considerable time in NorCal...my medical card is from California, but is valid in MI due to the reciprocal agreement MI has w/other medical states...i have had other encounters w/various other Police agencies in the State & they have NEVER gone the way this one did...this entire incident was a bunch of bs...i tried to contact Matt Abel about this, but i was handed over to some other lawyer in his office who i didn't think should be the one to handle my case...and due to other commitments i have in Cali., i have been unable to find the time to find another attorney...any suggestions? Also, i have not received my meds or my money...my card was returned to me when i was released...

Another thing that bothers me about this story is your medical card from another state IS valid in MI. You can not obtain medicine from a caregiver, but another card holding patient is allowed to share with you...and that would be legal obtained by a legally carded patient...whether or not the card is from MI....

U can knock my posting aqll day but I never would carrymeds into a casino. ANd I never carry more than 1,000 in my pocket even into a casino for fear of being robbed outside...this is the DDDD..Detroit GLOCK CIty. People get shot over Jewelry , shoes or hats inthis scity if your in the wrong place at the wrong time. Go ahead and KNock it...I feel bad u got fuxed with but go SUE them and get your money back.

i wasn't knocking your post, just clarifying what happened...and while some may feel that the "D" is dangerous, i really don't...i've spent considerable time in ALL parts of the city & i've never had any issues of any kind...if you go to Detroit looking for trouble, you'll def. find it...but if u're cool with ppl, they are usually cool with you...and i would like to say "thank you" to everyone who has commented on what happened to me...i really appreciate the concern y'all have shown...

Well all I can say is that you better check up on your card Lmfao...Either way the first thing you need to do when being harassed over MM is Shut the F*&K up! You know, use your right to remain silent..Which is hard to do when you are pissed and drinking. That really sucks though I would look into suing anyone and everyone involved. The NAACP helped that wal mart case sue over wrongful termination for dropping dirty..Look into that! The more people fight back when they are harassed for being legal, the better off everyone is!

 

What will they do if Pot is legalized for recreational use down there lmfao..Make sure you put your 2 cents in on that vote.

i wasn't pissed & drinking...i was celebrating my 30th b-day & having a hell of a good time till this all went down...and why would i shut up if i'm being harassed? the whole point of getting my card was to not have to hide in the shadows anymore...by keeping quiet you only give the powers that be more room to harass...think about it

I glanced at this thread and it is my understanding that the guards were PRIVATE bouncers at a PRIVATE club?

 

If so, when they asked you to leave and you declined you became a trespasser! They had every right to pick you up and throw you into a snowbank!

 

I know, that happened to me once at Sparty's Bar in Lansing when I was a law student. I had my head down on the bar and a bouncer came on one side and said something. I tried to explain that I am DEAF in that side and did not hear him. He said: "You have to leave now" and I tried to explain again. Whereupon 5 bouncers grabbed me and threw me outside into a snowbank just as a cop car pulled up. I complained to the cops, threatened a lawsuit, threw my "weight" around as a law student etc. The cop just smiled at me and asked: "If they asked you to leave, what was your legal status with the bar at that time?"

 

I smiled and thanked the nice officer- you see, once they ask you to leave and you don't, you are a trespasser. The only duty owed to a trespasser is the duty to refrain from causing physical injury.

 

HOWEVER, they STOLE your property and I would file a small claims case at least to get it back, or the monetary equivalent.

Ah reason # 337,222 to AVOID DETROIT. It is a city swirling the drain and the people running it are just trying to get as much money out of that hole as fast as they can before we hear the big Whooosh and poof just a big hole with the bankrupt GM building sticking up from the rubble as Detroit will clog the toilet that is Toledo.

Next time you encounter a Detroit Cop just start discreetly waving around Benjamins and watch the drama disappear. Probably get a police escort too!
