Detroit Police At It Again

just a lil' update for everyone...i've contacted the ACLU, Detroit Free Press & the Fox2 problem Solvers regarding my incident...i also just spoke with the Risk Manager from the Casino...after i e-mailed the Casino regarding what happened, they got back to me asap...i have a meeting set-up with them in a few weeks when i return to MI...they want to come up with a solution that will avoid litigation...thanks again for everyone's concern...by ourselves we are just a lil' voice, but a bunch of lil' voices makes up one BIG voice...and while i never had intentions of being an advocate for the Medical Marijuana community, i'm in this fight now...and i promise i'm not someone who is afraid to make waves, big or small...maybe this incident will be the one that FINALLY opens the eyes of the powers that be that it's time to LEARN this "new" law & to respect it...

I glanced at this thread and it is my understanding that the guards were PRIVATE bouncers at a PRIVATE club?

 

If so, when they asked you to leave and you declined you became a trespasser! They had every right to pick you up and throw you into a snowbank!

 

I know, that happened to me once at Sparty's Bar in Lansing when I was a law student. I had my head down on the bar and a bouncer came on one side and said something. I tried to explain that I am DEAF in that side and did not hear him. He said: "You have to leave now" and I tried to explain again. Whereupon 5 bouncers grabbed me and threw me outside into a snowbank just as a cop car pulled up. I complained to the cops, threatened a lawsuit, threw my "weight" around as a law student etc. The cop just smiled at me and asked: "If they asked you to leave, what was your legal status with the bar at that time?"

 

I smiled and thanked the nice officer- you see, once they ask you to leave and you don't, you are a trespasser. The only duty owed to a trespasser is the duty to refrain from causing physical injury.

 

HOWEVER, they STOLE your property and I would file a small claims case at least to get it back, or the monetary equivalent.

 

In this case they "bounced" on him because they were preforming an illegal arrest.

 

They were attempting to detain him for local authorities. When he tried to leave was when the confrontation became violent.

you can bet i won't...i'm bringing my attorney in with me, just in case...what do all of you think 3 days of your lives is worth? & the embarassment & humilation of being walked thru the Casino in handcuffs while your whole family watches? to me personally, a whole hell of a lot

talked to the Casino again today...i asked them for a copy of the video/audio tapes & any written reports, but they said i couldn't have them...they want to avoid any litigation, but they are leaving me no choice...guess if they want to play games, we can play games...the meeting i have with them should be interesting...i'll keep y'all posted...

sorry you were a victim of armed robbery by "peace officers". perhaps the solution lies in bankrupting the municipalities involved with scores of lawsuits. i look forward to hearing of a successful resolution for you. i.e. armored cars full of cash transferred from the rogue municipalities to you. i wish you and your family all the best. i'll follow this closely.

i was never asked to leave the club...they were actually trying to make me stay there against my will...

 

"While we were standing in the lobby area of the club, one of the security guards approached us & told us we had to leave."

 

HUH? Thats your words and it sounds like they asked you to leave.

when i said they never asked me to leave, i was refering to when i was back in the detainment area...when this all started inside the club, we weren't ordered to leave & refused & our actions would hardly qualify as trespassing...because regardless of being "inside" or "outside" of the club, we were always on the Casino property, which we were more then welcome on...you follow? i guess i should have explained that differently in the beginining...
