Michigan smokers are about to be more limited on where they can smoke tobacco!

 

New Michigan "No Smoking" Law

Effective May 1, 2010, Michigan PA 188 of 2009 will prohibit smoking in any "place of employment" in

 

Michigan, with narrow exceptions for Detroit casinos and for certain "cigar bars," "tobacco specialty retail stores" and home offices.

 

"Place of employment" is defined as: ". . . an enclosed indoor area that contains 1 or more work areas for 1 or more persons employed by a public or private employer." "Place of employment" does not include a motor vehicle or outdoor areas.

 

"Smoking" is defined as: ". . . the burning of a lighted cigar, cigarette, pipe, or any other matter or substance that contains a tobacco product."

 

The new law requires employers to take the following actions:

 

Clearly and conspicuously post "no smoking" signs or the international "no smoking" symbol at the entrances to and in every building or other area where smoking is

prohibited.

 

Remove all ashtrays and other smoking paraphernalia from anywhere smoking is prohibited.

 

Inform individuals smoking in violation of this Act that they are in violation of state law and subject to penalties.

 

Ask an individual smoking in violation of this Act to refrain from smoking and, if the

 

individual continues to smoke in violation of the Act, ask him or her to leave the place of employment.

 

A person who violates the new law is subject to a civil fine of up to $100 for a first violation and up to $500

for a second or subsequent violation. A person alleging violation of the new law may bring an action for

injunctive relief within 60 days after being on premises where smoking is prohibited by the new law.

 

The new law prohibits an employer from taking any retaliatory or adverse personnel action against an

employee on the basis of the individual’s exercise of or attempt to exercise his or her rights regarding a

place of employment (presumably, the right to insist that smoking not occur in the place of employment).

YES! Sure to ruffle some feathers - but I am very happy that when my wife and I go out to eat (starting this Saturday) or play cards that we won't have to put up with all the cigarette smoke.

Hey there's a lot of people who are severely allergic to smoke and they just wanna breathe! Cigarettes are addictive and secondhand smoke is a health hazard. Make fun of progressives all you want but this is a matter of public health, I know some severely affected people who cannot go to some places because of the smoke, they get very ill and almost throw up. You wanna smoke yourself to death be my guest but don't kill others in the process. I know a woman who's parents smoked while her mom was carrying her, and all during her childhood, she can hardly breathe, her life is a living hell. If I were smoking and someone said it bothered them I would stop and that would include MM if it were me smoking that. People have the right to breathe.

What if you live near a bar or late night restaurant? In a few weeks you would likely not be a supporter of this law. There will be lots of loud, drunk smokers outside of bars late at night. Here in this little town, that will likely irritate a few dozen homeowners close to downtown who might have their windows open at night.

 

Might not happen here, but that's the scene my brother told me about in two other states that have gone totally non-smoking.

 

P.S.: no offense to smokers -- there are plenty of loud, drunk non-smokers also; I just think they're more likely to stay inside the bar.

I'm not happy about this.

 

I support no smoking everywhere except bars. Drinking and smoking go hand in hand. Restaurants should be no smoking, everything else already is but bars should be left alone. Bars already have the option to be no smoking but the demand isn't there for them to do it.

 

That said I will be heading out to a bar tonight for the first time in a long time to enjoy the wings game to enjoy freedom one last time.

I lived in colorado when there smoking ban took place and I agree everywhere else is fine leave the bars alone but thats just my opinion. Bar owners out here have no idea of the headache its gonna cause them till they get used to it. When drunks want to take there drink outside and some bars wont let them. Adding extra Security outside for all the people smoking on the deck. All the people throwing there cigs all over the place around the bars doors dont think for a second the majority of the people will use ashtrays outside because they don't.

 

For the most part its a wash on bar buisness from what I noticed working at a bar during the whole ordeal. You will lose some customers but you will gain some of the non smokers which don't really spend that much money on drinks. That is just what I experienced.

Like the law or not its still the government taking away peoples rights>

I no longer smoke, have quit for 10 years now, but still believe these no smoking

laws are somewhat of discrimination I look at it this way, you don't like what's on tv, change the channel,

if you don't like the smoke go somewhere else. I really can't see stopping smoking in bars

and certain places like that. Once you start loosing freedoms over a cause, is it worth it in

the long run?

This is a Christian Right movement law. It is called legislating morality.

 

If so many non smokers wanted non smoking bars, why didnt they just open one themselves?

 

Because there arent enough to sustain a business.

 

Just what the state needed, another law that will cost the state jobs.

I am glad that this is finally through. To tell you the truth I'm sick of going to eat and as soon as I get my food the people next to me light up a smoke and it always seems to travel right to my face. Here let me make an example, you sit down to eat and I come over start burning plastic by you are you going to enjoy that? Just kick the habit man... I did maybe that's why I hate it so much. I just thought of it as every time I took a hit I was getting that much closer to death. Sucking in death is all it is.

I'm a smoker and feel that the no smoking in workplaces is a great ideal. The fewer places I can smoke the less I smoke. I don't drink but wish they would have exempted bars. The loud drunks standing outside of neighborhood bars is going to problematic. I have several friends who only smoke when they are drinking, the two just seem to go together.

They dont have the funds to inforce the smoking ban. So light up while you eat just like usual!!
