Patients Without Cards?

i am a registered c.g., i signed on a new patient about two months ago. My new patient has not recived his card yet, and niether have i. what im wondering is if since it has not been denied yet, am i protected as far as giving him meds? I cant see making him suffer because the states slow.

yeah so like you sent the paperwork certified mail with delivery conf. as recommended so you got that dated card with the siggy from the state. From that day wait fifteen and if no rejection letter wait till day 20 from that date on the states siggy conf. card you paid for no denial plant your beans..Thats how it has been explained to me over and over and over.

 

hope I was told correctly

 

bobandorey said it differently sounds like from check cash with what they say...

 

Either way always keep paperwork in your car of the papers you have and in your room as u prolly know..

If you are registered, you can provide. But....make sure your patient is registered. Check to see if they cashed your check. If they did, then you are approved. Count 20 days after that and the card should be sent to you. Print a copy of both the back and front of the check, also, the physicians form copy, and a copy of your application forms. Carry one with you in your vehicle.

section 9 (b) If the department fails to issue a valid registry identification card in response to a valid application or renewal submitted pursuant to this act within 20 days of its submission, the registry identification card shall be deemed granted, and a copy of the registry identification application or renewal shall be deemed a valid registry identification card.

I have been thinking about Ms. Chocolates post all day, and the more I think about it the more it bothers me.

 

There is a lot of half baked advice on these forums. There is only one way to stay as safe as possible and that is to operate as fully within the boundaries that this new law offers those in true medical need.

I did not suggest that people not register. I pointed out that there are two levels of protections. One level is more restrictive, but more protective. There is no need to sit and debate with any officer. If you are within the limits; with a card you are not arrested (Section 4), without a care you are (Section 8). People have reasons for whether they register or not.

 

The question asked was not if one should register, but if one without a card can process cannabis. You do not have to have a card to be legal, but you do have to have a doctor’s opinion!

Your right Ms.C, the law was written to provide protections to both registered and non registered "qualifying" patients.

 

"qualifying" meaning a doctor has opined that marijuana may provide relief.

 

Whome?, this has been debated and resolved in other threads, check them out.

Would someone with only a doctors approval want to sit on the side of the road, with meds in the car, and have a debate with a police officer regarding the finer points of the law?

 

There will be no argument, you will be arrested.

 

While I have never been through the legal system, I can only imagine a $200 card would be much cheaper than hiring a lawyer to argue an affirmative defense case for you.

you know whether you have dr.s aproval or paperwork, your going to court, Im not sure the card will even help in most cases, I agree with ms chocolate, ;at least with just a dr. saying it will benifit you, your not registered with the state,

and I have been thru 3 court cases and am going thru a cps case also! I realy think at this time I would have been better off w/o the paperwork or card!

When you start thinking this way..... Then remember the people who got off because they had a card or paperwork. They might not stick out in your mind because it wasn't a big splash with a lot of outrage and rallies. Many have benefited from just the paperwork. Look at that dude that was caught smoking in the casino parking lot. He was under federal charges. All he had was paperwork and proof he mailed it. The feds let him off the charges when MDCH verified his paperwork. It works. You can't deny it. Of course a bullet proof vest won't stop a head shot. They still wear them. Some wear them and never get shot either. Would you wear one after your buddy got shot and killed? How about after people are shot all around you? Better put your vest on even if it makes you look fat. LOL

Everyone in any cannabis court case is thanking their lucky stars they had medical paperwork before they were caught. Without exception. Many wish they had it.

As long as people realize that they can obey the law (wait the 20 days) and still go to jail....temporarily.

 

You haven't broken any law, but you could still be sitting in jail because some police do not accept "paperwork".

 

You most likely won't be convicted of anything or even charged (if you followed all the rules), but you will still have to sit in there for a while and sweat it out. Not a pleasant thought, even if you are innocent.

 

So if you have "paperwork" and no card, you can feel comfortable in the fact that you are obeying the law, but I would not assume that will keep you from being arrested or at least detained.
