Saginaw County sheriff’s deputies, with federal Drug Enforcement Administration agents, made seizures at the homes of two medical marijuana patients last week.

 

Saginaw County Sheriff’s Detective Sgt. Randy F. Pfau said the seizures were some of the first from registered medical marijuana users in Saginaw County since the law’s November 2008 passage. The patients weren’t following state guidelines, Pfau said.

 

Prosecutors haven’t charged the residents, and because the investigation is ongoing, Pfau declined to discuss the nature of the violations.

 

“I don’t want people that are doing this for the appropriate reasons — for medical use — to think that the Sheriff’s Department is going to kick in their door in some day,” Pfau said. “As long as they’re operating within the required law, we don’t have a problem with it.

 

“We’ve come across several others who were operating inside the law, and we took no action.”

 

Homeowner John F. Roberts, 48, of Thomas Township said the use was appropriate: to treat pain and other ailments of patients who need his “medicine.”

 

Roberts said he and his fiancée, Stephanie Whisman, 38, are caretakers for five patients each, which under the law allows them to possess 12 plants and 2.5 ounces of harvested marijuana per patient.

 

“The true victims are the patients we are trying to assist,” Roberts said. “Now my patients are going to have to suffer because they can’t get their medicine.”

 

He said some of his patients have terminal cancer, rheumatoid arthritis and other chronic diseases and ailments.

 

Pfau said tests by the State Police Crime lab will verify whether seized plants, harvested marijuana and other cannabis-derived products — such as oils and butters — are in fact marijuana; and the findings will be turned over to the Saginaw County prosecutor’s office.

 

Authorities said they also seized 88 marijuana plants, “a large quantity of processed marijuana” and three guns from the home of Edwin W. Boyke, 54, of Saginaw Township.

 

Boyke said he uses medical marijuana for pain associated with a pinched nerve in his back and because he doesn’t want to get “hooked on Vicodin.”

 

He disputes the number of plants deputies reported confiscating but he admits he had 17 more than the law allows. He said his son-in-law, a registered medical marijuana patient, also uses his grow space, so he was legal to have up to 36 plants and 7.5 ounces of harvested product.

 

About 20 of the plants were clones, clippings from other plants and hadn’t rooted yet, he said. Boyke said he is new to growing, and so far harvested less than an ounce from four plants.

 

Deputies also seized 4 ounces of dried marijuana, a 42-inch TV, a 2008 Chevy Impala, guns, two lawn mowers, an air compressor, a dehumidifier and a lawn blower from Boyke’s home, he said.

 

The next day, Boyke said deputies gave him the opportunity to recover his personal items in exchange for $5,000 in cash. He said, after seeking legal advice, he paid the fee, which Pfau said was charged for impounding the items.

 

Boyke said the marijuana, TV, dehumidifier and guns were retained by the department.

 

He said he’s not sure if he’ll grow any more for himself or his patient.

 

“Right now I’m afraid to do anything,” he said. “They’re just harassing anyone they can.”

 

Saginaw sheriff’s deputies and federal agents plucked a leaf from each of Robert’s plants during their search, Roberts said, for the purpose of testing in case he later is charged with illegal possession of marijuana.

 

In addition, deputies seized about 4 ounces of harvested marijuana, a pound of cannabis butter, a bag of leaf clippings for making butter and a quantity of “Rick Simpson hemp oil” — a liquid cannabis extract ingested orally for pain, Roberts said.

 

Kim M. Zimmer, 54, is a disabled Saginaw resident and one of Whisman’s patients. She said she has fibromyaglia and stomach adhesions, and has battled stomach, colon and cervical cancers.

 

“This stuff works great for me,” Zimmer said. “I got my first ounce last month from them ... and now I’m really in pain, because I have no product at all.

 

“If I have to, I’m going to have to go into the black market and buy it off the streets.”

 

Roberts, Whisman, Zimmer and Boyke are members of the 140-member Tri-City Compassion Club, an organization that advocates for medical marijuana use and assists patients with procurement, consumption and growing information.

 

On Monday, Roberts tended about 112 marijuana plants in the garage behind his Thomas Township home. The bright grow room is filled with the sound of pumps and circulating water. Outside and inside the white garage, the musk of marijuana is distinct. He said it will be months before he can harvest more medical marijuana.

So it really is about stealing people's property and making money? After all, what the hell else did the TV and lawn mowers have to do with this case. I try, I really try, to think that the majority of LEO are good, upstanding people, but when I read things like this, it makes that belief very difficult. Who are they "protecting and serving" with these actions?

 

Ultimately, they'll get their just rewards, as Karma is a complain (sorry about the language) but in the meantime sick people suffer so that the police can have a nice new TV. Disgusting.

 

Has anyone stepped up to help these patients yet? I would, but I don't have any extra right now...

If that is the case then why does Pfau need the assistance of the DEA.............since that is a Federal branch of government.

 

This smells fishy and better be stopped, before these jokers get out of control.

Probably because it was a grown operation of a large amount of plants. Which if it violates the MMMP would also fall into federal turf?

Before we jump conclusions, remember, the person who posted the story retrieved it from mlive.com. This is a news site, they could have easily left out details, or been provided with an incomplete set of details. Lets not shoot the messenger. Only time will tell what really happened, the DEA doesn't get involved over bread crumbs.

thats how clare co feels,if your in the law ,no big deal.alot of this happens because people tell each other what thier doing....just a thought

From what I heard there was an incident with ED at the Soaring Eagle Casino.

 

He was caught medicating in his room at the Casino Hotel (which is Federal property) by the Tribal Police, they asked him for his meds and wanted him to leave the Hotel/Casino and the incident would be over.

 

Ed refused to give up his meds, but he left the Hotel/Casino complex. (so I assume they turned him in to the Fed's) A while latter he get's busted by the DEA with the support of the Saginaw sheriff's dept. And he happens to be over his limit on plants, with unrooted clones. OUCH

 

I believe this is how the Fed's got involved with Ed, they may have been investigating him for a while, along with the Saginaw County Sheriffs Dept. as they assisted in the bust!

 

The Tribal police have the Feds to back them up, all Indian reservation property is Federal Land, Casino's included and they are not bound by State law. You lose your legal status as a Michigan MMJ patient when you are on Federal property. Keep this in mind when your at the Casino's.

 

Use medibles, tinctures, topical oil or maybe a vaporizer. Stay safe

 

Cheech and Chong are at the Soaring Eagle Casino on May 7th. Be careful with your meds there.

 

 

The law states enough plants to keep an uninterrupted supply though! Should unrooted clones count as plants?

 

We might get a precedent out of this case, and we'll find out how it will be interpreted in the courts. Just what will be allowed? Will unrooted clones count towards plant totals or not?

 

Of course the incident at the casino might not have had anything to do with the bust either? It's just speculation at this point.

I always wonder if that person let one joint slip threw the crack. There seems that everyone of the stories i read the people who have been raided are over in plant count or some little detail. The moral of the story is stay in your count dont take extra cuttings, the cops count them, what don't we get about that. I mean i feel for the people and think is bull bunny muffin, but the guy in his own story admits his guilt. When he says about he nephew using the space if it puts you over it puts you over. The other thing iu dont get if you and four growers wanna work together do it, but grow in four spots that way its harder for Johny law to shut you down. With that said, i wish them the best of luck and think its bull bunny muffin that they are going threw this, but wise up people stop pushing the limits.

I just want to clarify some of the controversy regarding Eds case because this is the truth and Ed is here with right now with me as I help clarify his story. One that we all fail to recognize is that were are all patients Ed is a patient this poor man has had 2 brain surgery's with one of the surgery's taking out a piece of his right temporal lobe and regularly sees a neurologist he also suffers from chronic pain resulting from a pinched nerve now this man is disabled and his actual age is 64 this poor man can not even remember his own age half the time and I do not say this to be critical but Ed is some what mentally handicapped those surgerys did effect some of Eds mental capability and changed him for life this is from Ed himself quote since he says in his own words the second brain surgery knocked the socks right off me and still does that is the surgery that removed some of his right temporal lobe this surgery has effected this mans ability in memory and has effected ability to write plus basic math and even express his thoughts and also emotion and suffers from depression and anxiety this what this man is being treated for. I think we all fail to recognize that we are patients and that patients can have limited physical and mental capability due to there disability. This are the people that Saginaw County Sheriffs Department are going after can you think of anyone more vulnerable other then maybe the terminal cancer patient being treated by Hospice this is the true Story God Bless and help us all

Bud habit i feel for ed and his condition. Although the law is clear on how many plants one can take care of. Ed should not of let that other person under his lights. I know its dumb that there are laws about who,where and how cannabis can be grown, but there are, so those of us who have the right to do so need to respect it and follow the guide lines. Till this stupid Prohibition is lifted once and for all.

I read some of the comments about your Sheriff following the news article , and many suggesting not re-electing him.

If the fellow is as bad as some of your neighbors say, and if your county did approve the mmj law by more than the statewide

margin, maybe this is an opportunity to just recall the guy and remove him from office. Why wait for the next election?

Apparently it isn't just mmj supporters that are unhappy with him.
