Lawyers: When Are The Lawsuites Going To Start?

The more time that goes by without any lawsuits starting the bolder some leo is becoming.

 

We need to send a chill up their backbones.

 

The longer it takes the more people will be getting screwed over.

 

We all know there are several cases out there that could have suits filed.

 

What is the problem?

I think a class action suit should take place also.

 

However ..that would be toward the state. Someone else suggested that counties be sued instead of the state.

 

And if you received less that $1500 in damages, how about small claims?

 

Do we need to wait for the lawyers?

OB i think that may happen but we have to Waite till we are FREE first be for we can sue you have to Waite till it's over i wanted to talk last night to mike K the Lawyer on the radio but he ran out of time

 

i think we have 5 lawyers on are case some body is going to get paid inn the end

We are playing defense now, trying to stop the spread of ordinances. Our attorneys are working hard and have been making contact with various governmental agencies to stop ordinances before they get passed. We have also been giving interviews with the press letting them know that suit will be filed and/or test cases taken. We are currently trying to unite the community, because that will be our true strength, people power. Suits take years to resolve. Large groups of angry voters take seconds to have an impact.

 

We will be taking legal action soon. You always have to be careful that you don't choose the wrong case or ordinance and actually end of setting the movement back. We will in every instance support our community to the fullest extent possible. We now have a very intelligent and knowledgeable lobbyist that understands our position, that our law is sacred, and he is fighting on the legislative front. We are fully engaged in all aspects on the legal front as well as the adminisrative front. We understand that we are at war.. with those that would undermine the will of the people, and we will win, because our cause is righteous.

 

Please, if you can, show up July 1st. If there was ever a travesty of justice, it is this one. We must as a community unite and make events like Saginaw send a clear message, That we're mad as hell and we're not going to take it anymore.

False arrest, vandalism, armed robbery, assault with a deadly weapon, child endangerment ..

 

Let it all slide?

 

The only thing I see from letting it slide is that a lot of lawyers get a lot of money.

On the night of March 6, 2010, myself & 10-12 of my family members were celebrating my 30th birthday at “Amnesia“. I reserved a V.I.P. table w/bottle service & I also hired All-American Limo to transport us to the club. When we arrived at the club, we were taken upstairs to our table & seated. Most of our night was spent in the V.I.P. area having drinks & celebrating. The only time anyone in our group really left our area was to use the restroom. At the end of the night, I made my way downstairs with one of my cousins to wait for the rest of our group. While we were standing in the lobby area of the club, one of the security guards approached us & told us we had to leave. We tried explaining to him that we were just waiting for our party to come downstairs so we could make our way to the limo, but he continued to give us an attitude about standing there. The security guard then proceeded to tell us that he smelled marijuana & asked which one of us had it in our possession. I replied that I had some “medical cannabis” in my pocket, along with my California “medical” card. At this point, he instructed us that we needed to come with him. Not wanting to cause any trouble, we followed him. During our walk to the detainment area, I informed the guard repeatedly that I was a legal “medical” cannabis patient & that I had the necessary documentation to prove it. Once I was in the detainment area, I handed over my meds & my medical card to one of the guards. While I was waiting for a Supervisor to come speak to me, another security guard began to verbally assault me. He repeatedly told me that I needed to “sit the flower down & shut the flower up”. After his orders were ignored, he then proceeded to physically assault me by pushing me backwards into a conference room. At this point, I asked if he was allowed to put his hands on me & if I could be physically restrained if I tried to leave? Once I was informed that the guards are not allowed to physically touch you, I made my way out of the conference room & headed for the door that lead back to the gaming floor. Before I made my way through the exit door, I asked for my “meds” & my “medical card”. I was told I couldn’t have either item. After being told I couldn’t have my property, the same guard who had previously assaulted, once again shoved me. This time, I fell through the door to the gaming floor on my back & was immediately restrained by numerous Casino guards. This was all witnessed by numerous members of my party & other Casino patrons. In no way & at no time during this altercation did I resist or struggle. Once I was face-down & handcuffed, I was taken back into the detainment area & placed in a cell. While in the cell, one of the Casino security supervisors came in & removed my handcuffs & gave me a bottle of water. I told him that I wanted the cops called immediately. After some time, two DPD officers arrived & informed me that my “medical” card was not valid in the State of MI & that I was in violation of the “Controlled Substance “ Act. I was also informed that the $2600 I had in my possession was also going to be seized. Once the officers were ready to leave, I was placed in handcuffs & walked through the casino to the parking garage. After being placed in the back of the squad car, I continued to ask the passenger seat officer why I was being taken to jail? He repeatedly told me to “shut the flower up, or he would shut me up”. I continued talking. Before we even made it out of the the parking garage, the passenger seat officer instructed the officer who was driving to stop the car. He then proceeded to get out of the car & came into the back seat & was hitting & choking me. All while telling me to shut my mouth. I continued talking. After our “incident”, we made our way to the 11th Precinct. Once we arrived at the jail, I was placed in a holding cell & kept there until Tuesday. At no time was I read my rights, nor was I given access to an attorney. I was also never informed of why I was there, or when I would be released. After three days, I was taken to the Courthouse downtown & told that they “lost” my paperwork & I was escorted to a side door & released.

ordeal. Informing people of how often this happens

lets us know that WE ARE NOT SAFE.

I wonder how many ways they had to split the $2600.

What did it take to get another registration card?

I'm sure it isn't like loosing your DL, going to DMV

paying a fee then, rec'v a replacement in 2wks.

Sue for what? What is your proposed cause of action?

 

What you fail to understand is that there is governmental immunity in this state. The state can only be sued for what it says it can be sued for. You need to be able to squeeze your cause of action past those restrictions.

 

Secondly, most government employees have qualified immunity which prevents them from being sued for doing certain things in the course of their employment. A judge, for example, has judicial immunity. The list goes on. It isn't as easy to sue the state as you may think.

 

Thirdly, there are ways to sue the state, etc., but I can almost guarantee it isn't going to happen in small claims court because most actions that could be brought against the state would not be issues that the small claims division of a district court would have jurisdiction over.

 

As far as people saying, "sue for armed robbery," etc.....well, read the elements of the crime and you'll see why it's nonsense.

 

Can the state be sued? Probably. But you can't sue the pants off the state for everything people think you can.

I especially wonder because if he was at a casino (I'm not familiar with this nightclub called "Amnesia"), that's just walking around money, certainly nothing to attribute to the drug trade, and those casino employees surely know that.

I had the sense that he said "Amnesia" so as not to give

the actual name of the casino. I may be wrong though.

Even if nesta got his cash back it's still an abomination,

a total and unjust use of force.

Nesta, I'm so sorry this happened to you. This is outrageous! Incidents like this are prob'ly more common than we realize. These stories have to be spread far and wide. I feel so bad for anyone who gets victimized by these abusive leo's. Our society is so abusive, and they get away with it, so they keep doing it. These people need to be fined heavily and lose their jobs, never to work again in those professions. This immunity business is a crock, too. No one wants to be responsible for their wrongdoings- until they are, or are forced to be, this crap will continue. I hope you can sue them for all they have. If massive lawsuits were filed, this kinda thing would stop, IF there were any real justice.

the club is inside Motor City Casino...& no, i have not received my money back...& i was not & have not been charged with ANY crime...i am still dealing with this whole situation...it's been almost 4 mo. since this happened...i contacted one attorney about this matter, but he was flaky & i'm now trying to find another...i'm having difficulty in doing so due to the fact that i'm currently living in Northern California...

What is the problem? I yearn for a law suit. Im told i have to wait for the criminal part of my case is over. Im thinking that will be the day after i die. This waiting game is in their LEO's best interest. If i was to die they dont have to say they were wrong. So easy a caveman could understand it. I broke no laws i want my property back. I want paid for the plants LEO killed
