Backyard marijuana grow brings felony charge against Midlander

A 65-year-old Midlander is in trouble with the law after a tip pointed police to marijuana being grown in the backyard of a home in plain view from a city sidewalk.

 

____ faces one felony count of delivery or manufacture of marijuana, punishable by up to four years in prison.

 

Midland Police became aware of the situation after a man approached an officer downtown to report his daughter had observed what looked like marijuana growing in a home’s backyard on Aug. 16. Officers checked it out, walking down a city sidewalk in the area of West Allen and Reardon streets. From that public vantage point, they saw a large, mature marijuana plant growing behind a West Allen Street home.

 

In all, 11 plants were confiscated from pots in the backyard. The suspect, who was not home when police first arrived, eventually returned and spoke with the officers.

 

Court documents state ____ has a valid medical marijuana card, and is a caregiver. Caregiver provisions of the Michigan Medical Marijuana Act state that plants must be kept in an enclosed, locked facility.

 

_____ told officers he could not afford the necessary utilities to provide heat and light to grow the plants inside. He does not have a job, and collects disability, not bringing in enough money to cover his monthly bills. He also shared that he is on payment plans through various courts.
