will that 470k be used to inspect the dispensaries? hmmmmm

 

This seems like a tricky subject.  If a "dispensary" is acting outside the MMMA protections, then how could any bust be MMMA enforcement?  Same as a guy guy selling dime bags on the corner.  Busting him isn't enforcing the MMMA Act.    If the dispensary is protected by the MMMA, then maybe, yes, the funds could legally support looking at the dispensary.  Then again, if the dispensary is lawful under the MMMA, there is no need for enforcement.

 

LEOs have had a field-day with the idea that you're either in strict compliance with the MMMA or you're not, and therefore, if you're not, you're subject to the full wrath of CSA/PHC. 

 

This seem to be a catch 22 for LEOs.  If you're in compliance with the MMMA, then LEOs using such funds to inspect/raid is unfounded.  If LEO wants to say that you're not in compliance with the MMMA, they why the hell can they use MMMA enforcement funds to bust you, since they are going to say the activity wasn't conducted pursuant to the MMMA?  At that point, it wouldn't be enforcing the MMMA.

This sounds like a plausible defense argument in court.

good point.

 

it was only my guess about dispensaries. they could just be educating regular patients, you never know.

 

keep watching, filming, recording these jackboots and its easy to watch them make mistakes.

 

Something tells me that the LEOs aren't going to prepare seminars for MMJ folks as to how they can avoid LEO interdiction, which is what the MMMA grant money should be allocated for.  I see no other option. 

 

That said, and referring back to my previous post, there is no way LEO can use the funds for MMJ enforcement until they drop the attitude that you're either in compliance with the MMMA as they see it, or you're not, and therefor subject to one or more PHC felonies. 

 

If LEOs say that you're operating outside of the MMMA, how can they possibly say that they used MMMA grant money for MMMA enforcement?  And if they think you're operating within the MMMA, then there is no reason for their involvement in the first place = no reason to spend MMMA grant money for enforcement.

Shouldn't we, the patients, have a say in how OUR funds are spent? Having LEO give seminars on how to avoid problems would be an excellent (and fair) way to spend OUR money.

 

It would also be extremely entertaining to observe a police officer telling me how to comply with the MMMA.

 

Come on! They need to loosen up and have a little fun with this. They are way too serious about this pot thing.
