Don’t Beauregard that joint my friend.

    By Michael Komorn

Attorney General Jeff Sessions January 4th memo regarding marijuana enforcement is historic... and it should promptly be consigned to the dustbin of history. Mr. Session’s very name is a history lesson. Like his father and grandfather, he was named after Jefferson Davis, the first and only president of the Confederacy and P.G.T. Beauregard, the first prominent general of the Confederate Army. These were the men who lead the people of Alabama in their desire and purpose to join the “slave-holding

Michael Komorn Fights Against Asset Forfeiture in Michigan

    By Michael Komorn

Michael Komorn has worked tirelessly for his clients at Komorn Law PLLC to return property seized and forfeited to the police. The items and property seized often has absolutely no medical marijuana (or any crime at all) connection whatsoever. Just looking at the list of things seized, none of it makes sense. 4 wheeler? Gas generator? 401k retirement account? Cars purchased 20 years ago and restored. Ladders, children's birthday money taken out of their Hallmark birthday cards. iphones, ipads, c

Making A Federal Case Out Of Marijuana

    By Michael Komorn

Our client, a medical marijuana patient registered with the State of Michigan, was out for a boat ride and some fishing on his friend’s boat. What started out as a glorious day with intentions of sun and fishing on the Detroit river later turned into federal charges of possession of marijuana (21 USC 844, 21 USC 844a) when a Border Patrol agent pulled up to them and wanted to search their vessel.   Related: Michigan law regarding marijuana manufacture, delivery, and possession   The federal

Years of blood, sweat and tears to get Autism as a Qualifying Condition in the MMMA.

    By Michael Komorn

We have come a long way from 2013, when a parent submitted the first petition to add Autism as a qualifying condition within the Michigan Medical Marijuana Act. It was ultimately rejected due to a lack of any research materials and testimony. http://komornlaw.com/wp-content/uploads/2018/02/Final_Determination_Autism_436526_7.pdf In 2014, a Parent tried to submit a new Autism petition with some testimony about physicians treating Autism patients who qualify due to also having epile

Komorn Law recommends keeping medical marijuana card and protections.

    By Michael Komorn

After the legalization of marijuana in Michigan, some patients are thinking they could stop paying the state $100 for the special mmp card , and just use the recreational marijuana law to grow their medicine. A patient with a registered card can use the ultimate defense and immunity to avoid a driving under the influence charge. Only adults 21 or over are protected by the new legalization law, but no one yet knows how the new law will affect driving privileges. Is the zero toleran

Marijuana Businesses, Revenues And Banking

The Financial Crimes Enforcement Network (“FinCEN”) is issuing guidance to clarify Bank Secrecy Act (“BSA”) expectations for financial institutions seeking to provide services to marijuana-related businesses. FinCEN is issuing this guidance in light of recent state initiatives to legalize certain marijuana-related activity and related guidance by the U.S. Department of Justice (“DOJ”) concerning marijuana-related enforcement priorities. This FinCEN guidance clarifies how financial institutions c

Legalize Marijuana? Think Of Your Dog, Says Dea Chief

This is not an Onion Article. Recently, DEA Chief Michele Leonhart said, ”There was just an article last week, and it was on pets. It was about the unanticipated or unexpected consequences of this, and how veterinarians now are seeing dogs come in, their pets come in, and being treated because they’ve been exposed to marijuana.”   She was referencing an article that ran in USA Today which featured veterinarians in Colorado talking about family pets, mostly dogs, coming in who had eaten marijua

Do You Know What April 6 Is?

Five years ago the State of Michigan begin accepting application under the MMMA. The program actually went into effect on the 4th, but it was a Saturday, so nothing could be done.   Lots has happened during these five years. there have been compliance, bending, side-stepping, disobeying, changes, changes, re-writing, back-stabbing, under-table dealings, and a bunch of frustrations.   The thing that has frustrated me more than anything has been the attitudes concerning attentive forms of use.

I Was In Ann Arbor Yesterday

All week I received calls al texts asking about the Hash Bash. It was like people felt that they couldn't go unless I served as their escort. I had 5 doctors appointment this week. I was tired, sore, hurting; I had not planned on going. By Saturday morning, all but one of those people had called to say that they weren't going. That last person was my son. He must have texted me 4 times Saturday, he really wanted to go.   I didn't make it to the Hash Bash, but to the Monroe Street Fair, and I w

U.s. Supreme Court Upholds Arizona Court Ruling: Cops Must Return Marijuana

Remember the Sheriff from Arizona who stole a California patient’s medical marijuana? He just got told by the highest court in the land to give it back.   Related: Arizona Supreme Court Sets Example for other Medical Marijuana States   The U.S. Supreme Court upheld the Arizona court rulings which ordered Yuma County Sheriff Leon Wilmott to return the medical marijuana he seized from Valerie Okun, a California medical marijuana patient visiting Arizona. The Sheriff ignored the fact that Arizo

Decriminalization, Legalization On Michigan Ballots In 2014

At least eight cities and possibly a dozen more are presenting local initiatives aimed at legalizing or decriminalizing possession, use or transfer of small amounts of marijuana on private property by persons 21 or older. Similar proposals have been on the local ballot in eight other cities thus far with everyone of them passing.   READ MORE HERE

Medical Edibles And Cannabis Topicals Are Needed Forms Of Medications

I was discussing the edible use on marihuana with a group of acquaintances. Some of these people were smokers, some employed multiply uses, others how did not use- but were interested. The main thing that were all agreed on was that the MMMA was written with smokers in mind. We decided this because of the 2.5 ounce restriction on useable marihuana. Another thing we agreed on was that we had no issue with using the 2.5 ounces to produce something that we felt was friendlier to our particular ailm

Random Drug Testing For All-New Proposal That Is Gaining Momentum

A chilling new paper has been released by the American Society of Addiction Medicine (ASAM) which calls for increased use of random drug testing for Americans of all ages. The paper states that random drug testing is currently “underutilized” and ought to be expanded to include people of all ages in virtually all aspects of daily life. The paper was penned by former United States National Institute on Drug Abuse Director (and present-day drug testing consultant and profiteer) Robert Dupont (alon

Cannabinoids, Ketogenic Diets, Holy Basil, And The Ppar Connection

Cannabinoids, Ketogenic Diets, Holy Basil, and the PPAR Connection   Recently there's been a lot of talk, and even more confusion, about the use of cannabinoids in the treatment of pediatric epilepsy. The science behind the possible physiological mechanisms involved seem to have been all but entirely left out of this discussion. Though this paper is not meant to be definitive, this is an attempt by a layman to inject some science into this ongoing discussion. More importantly this is di

Deputy Attorney General James Cole: Prison Population Is A "crisis"

Deputy Attorney General James Cole spoke at the annual New York State Bar Association meeting and focused on a glaring problem in the Criminal Justice System: the huge prison population. Mr. Cole said that the Justice Department recognized that the overwhelming prison population was a threat to public safety, not because it was taking dangerous criminals off the streets, but because it was taking too many non-violent individuals away from their families and throwing them into prison. "Over ha

Banks Will Now Accept Deposits From Legal Marijuana Dispensaries

US Attorney General Eric Holder said yesterday that the Obama Administration will announce regulations that allow banks to do business with legal sellers of marijuana. Holder made an appearance at the University of Virginia on Thursday, 1/23/14, and highlighted the concern of what to do with all the cash generated at dispensaries. ”You don’t want just huge amounts of cash in these places. They want to be able to use the banking system…There’s a public safety component to this. Huge amounts of

Why People Plead Guilty To Crimes They Didn't Commit

I came across a great piece by Lordina Youngcourt, an Indiana based Defense Attorney. She highlights the problems within the Criminal Justice, system and brings to light how the cards are stacked against defendants. “Defendants don’t understand why this system that’s supposed to applaud honesty is telling him “if you want the deal, you have to lie.” So the whole plea system is very difficult [and] very ethically troublesome.” I encourage you to read the entire piece found here. Hawaii Wants To Grow Marijuana To Pay Off Debt

Before we get into it, I must remark on a recent documentary I watched, “The House I Live In.” The film explores how our country’s drug laws have come to be, and the negative social impact that the current drug policy has had on everything from the individual, family, police work, prison system, and economy. When people become jobless, hopeless, and desperate, they have historically turned to the black market economy of illegal activity. This is true of every immigrant group that has come to

Marijuana Soaked In Alcohol Is Not A Narcotic

I shall be writing more of my thoughts on this soon.       In 1973, the 36 Cal. App Court ruled in People v. Vargas, that marijuana soaked in alcohol is not a narcotic.     "As to the conviction for possession of marijuana, appellant testified that the jar found among his personal effects contained medicine for his rheumatism. Both Agent Velasquez and the court interpreter, Mrs. Ostendorf, testified that a mixture of alcohol and marijuana is commonly used by persons of Mexican descent in

The Future Looks Bleak?

So every day I read more and more about dispensaries, and government this and that.. LEOs hate this law due to lack of funding stemming from Marijuana arrests..   I was theorizing this morning with a buddy of mine..   I can see it now, the Government run dispensaries will cancel out our rights to grow our own, which in turn will put a halt to the "legal home grow" That will satisfy LEO cause they will now be able to raid each suspected home that has a grow and seize all the equipment and sti

Doctors Dropping Patients

Your in pain, you go to your doctor and ask for a prescription refill, they catch word that you have a medical marijuana card and refuse to see you again as their patient....why? Because the large corporations and hospitals are federally funded and it is illegal at the federal level to have marijuana or prescribe it.   I found that Denali Healthcare is now picking up a lot of these patients and is able to help them with their narcotics and medical marijuana use.   Have you had an experience

You've Asked For It!

After reading the Senate bill 660, I have to ask: "Isn't this what was asked for?" When the cry went out to tax and regulate marijuana, is this not what was wanted?   Keep in mind that we live in a country that is for the people, by the people. A country where businesses and corporations are people. A country where lawmakers perform in ways directed by the people who control their incomes. I doubt that there are no many who will not suggest that our lawmakers are indeed receiving funding from
